My neighbor pays less rent for the same flat

I figured it out that my neighbor in the same building is paying 100 chf less rent for her flat which is 2m2 bigger and on the second floor.
Besides mine is on top floor in the same building without elevator. She has a bigger fridge and newer bathroom.

I ask the property agency to decrease the rent but it is not accepted by excusing that she is an old tentant. But I found out that she rented out the flat 10 months before me. It can t be the case.. And considering the falling interest rates, the rent increase doesn t make sense..

What are my rights? Should I continue to negotiate on the rent? Can I complain the issue to any where?

You should ask for a rent reduction.

Info: 'Referenzzinssatz' went down -check your rental contracts

Why not? It is called free market where demand and supply defines the price. The landlord thought he could rent your apartment for this amount. You freely agreed. If you had found something cheaper/better/nicer you would not have signed the contract.

In other words: the time of negotiating was before you signed the contract. Now it is too late apart from rent reduction due to a lower Referenzzinssatz. See post above.

In Switzerland, the higher the apartment is in the block, the higher the rental will be. The reason for this is, there is a better view and not so much noise from the tenants above.

Anyway, you agreed the rental when you moved in, and that has no reference at all to your neighbour's rental. You made a contract with the owner. Only when your rental is being increased can your neighbours' rent be used as a reference.

This is pretty normal anywhere in the world, the higher you are the better the view the higher the rent. Can't see your complaint you are doing well to only pay 100CHF more for a higher level

It might depend on how many people lived in the apartment before both of you as well. If there was only 1 tenant before her, and 3 tenants before you, the rent for your particular apartment would have been raised more times than her.

Once I lived in a building where one of the tenants paid about two thirds of my rent for an apartment which was about 50% bigger than mine. That person had been living there for many years. Happens all the time in older buildings.

Interest rates don't matter for new rental contracts. They only matter for rent changes within existing contracts.

You signed a contract and thereby agreed to the current rent, didn't you? So you're bound by the contract.
The agency is only required to decrease your rent if your contract is based on a higher interest rate than the current reference interest rate. Otherwise you're pretty much out of luck. Sorry.

True that I live on a higher floor but my view is next building. Wheras that flat has a view to a quiet street.

And it is also true that I signed the agreement with owner without the knowledge of other's rent amount. But I think it is still unfair to pay higher rent for a worse flat.
As I experience, searching for an available flat was a painful process and I don t think that bargaining is an option for tentants in Zurich..

I was expecting that there is an institution or regulation for such cases. But reading all replies, there is not.

Tomorrow I will still give them a call and ask for renovation of my fridge without any increase in rent.
