Private landlord - deposit to personal account without contract

Hello

Please forgive me if this has already been asked:

I am due to move to Basel in June and have posted a 'room wanted' advert on www.wgzimmer.ch. I have had a number of responses to my advert and have been speaking with someone that has a room to rent in his apartment.

He initially emailed me with some details - location, cost etc and I responded asking for some additional information and photos which he sent me in his response.

I expressed my interest and asked that we talk via skype to finalise details as I am not able to be in Basel before my proposed move date, this we did and both the landlord and I agreed that I could and would take the room. The landlord said that he would confirm all with me the next day which he did and asked that I pay a deposit and a months rent into his Postfinance account - the details of which I have been supplied already.

I have responded saying that I will pay a sum of money into his account as a deposit to show my intent to take the room and pay the remainder on arrival to Basel and asked that he confirms that he is happy with this before I make the transfer - I am waiting for that confirmation at the moment.

My concern is purely based on the fact that there has been no discussion of contracts or a Mietkautionskonto/deposit account and I am of course, concerned about losing my money and not having my promised accommodation!

Has anyone had experience of renting a room in this way? Should I insist on the landlord arranging a contract and a deposit account? I have rented in the UK this way many times in the past without any problems but appreciate that the situation may be different in Switzerland.

I would appreciate any opinions and advice.

Dont do it this way as 90% its going to be a scam. Do it properly in a deposit account at your name in the bank

Hi gata,

Thanks for the quick response, I thought it may be, although I hoped that it wasn't - the landlord (supposedly) and seemed to email me back quite quickly with responses but since my proposal of a small deposit I haven't heard anything which was why I thought that something wasn't quite right.

I'll keep looking for a room!

Keep looking.
And I would refuse any deposit for a WG-room. One month in advance is enough.

Can you post the reply you got? Usually you can tell its a scam from the first or second email

Of course they ask for all kinds of crazy things. They usually don't declare these earnings to the tax anyway, the risk of struggling like hell to get the deposit back is too high in my eyes to take any chance with WG-rooms. I would only offer to pay the rent a couple of days before the start of the month. if there is any problem, it's enough money to negotiate about.
But when one urgently needs a room, one might not be able to be as picky as I. But be aware of the risks.

Hi OP,

I strongly advise you to remove the e-mail addresses from your posts.

Personally, I wouldn't pay anything to this guy's account. If he wants a deposit, you can offer to open your own account for it (it's called a Sperrkonto) and give him a copy of the account statement. Trust me, you don't want the hassle of getting your money back if he decides there is something wrong with the room/apt when you move out, with him refusing to pay you your deposit out of his own account. If you open your own account for the deposit and he hasn't claimed anything for damages to the apartment/room at the end of 1 year after the end of your rent, you should be able to access your money.
