Moving out and being asked to get appliances professionally checked

Hello all,

I have searched for this subject but cannot find any earlier discussions.

We are moving out of our rental apartment after being here for 4 years. Our agency has asked us to get an Expert (from V-Zug) to inspect the dishwasher, and washer and dryer.

Is this normal practice? We did not do this for our previous rental apartment.

If it is a requirement it should be clearly defined in the contract.

Out of two apartments, I've had one where this was not required and one where I had to organise it.

We just gave notice as well as we prepare to return to the USA. We also are required to have our dishwasher inspected and certified at our own expense...part of our contract. I know a couple others who have had to do this as well, so I don't believe it is unusual, but like the previous said, I'd check your contract.

PS: We do not have our own washer and dryer so not an issue for us.

This is often a condition of your contract, and you will be asked to produce the inspection report from the check at the handover.

This is often a requirement in the contracts. I encountered contracts with it too during my search for an appartment in the Zug area. However, browsing on the pages of the Mieterverband (section Zug) you will find, that it's not a legal practice.

In meinem Mietvetrag steht, ich müsse beim Auszug einen Service am Geschirrspüler vornehmen lassen. Dieser funktioniert aber bestens. Muss ich trotzdem einen Service vornehmen lassen?

Nein, die betreffende Klausel im Mietvertrag ist ungültig. Dies ergibt sich aus Artikel 267 OR, in welchem steht: \"Vereinbarungen, in denen sich der Mieter im voraus verpflichtet, bei Beendigung des Mietverhältnisses eine Entschädigung zu entrichten, die anderes als die Deckung des allfälligen Schadens einschliesst, sind nichtig.\" Somit müssen Sie beim Auszug nicht für den Service am Geschirrspüler aufkommen, selbst wenn das im Mietvertrag steht

Mai schickt ihr die Liegenschaftsverwaltung
ein Merkblatt. Es steht,
vor dem Auszug sei ein Service am
Geschirrspüler und am Tumbler
durchführen zu lassen. Bei der Wohnungsabgabe
sei dafür ein Beleg der
Servicefirma vorlegen. Sind die Mieter
tatsächlich dazu verpflichtet?
Massgebend ist der Mietvertrag.


Das kommt darauf an. Ist der geforderte
Service im Mietvertrag festgehalten,
werden die Mieter kaum darum
herum kommen. Meistens stehen
derartige Verpflichtungen allerdings
nicht im Mietvertrag selbst, sondern
in den allgemeinen Vertragsbedingungen,
dem so genannten «Kleingedruckten
».

In diesem Fall sind sie
verbindlich, sofern der unterzeichnete
Mietvertrag auf diese verweist oder
sofern die allgemeinen Bedingungen
ebenfalls von der Mieterschaft unterzeichnet
sind.
Eine Ausnahme
gilt, wenn eines dieser Geräte
defekt ist. Was aber auch immer im
Vertrag steht, für Rechnungen von
mehr als 150 Franken müssen die Meiers
nicht aufkommen.

That's interesting. We talked to our potential agency (after telling them that we changed our mind, partly due to this dishwasher requirement) and told them what I have stated above about the requirement not being legal and they just answered that they knew...
