noisy apartment - please help !

Dear All,

I am driven to distraction by the noise coming from the underfloor heating system/machine /(for the whole building 10 aptmts) which is located under our ground floor apartment. Apparently this machine also heats the hot water and it runs incessantly all hours of the day (up to 1am and starting from 5am) and night which results in us not getting much sleep at all. a rattling, shaking noise aaggghhhh (((.

i have phoned the verwaltung and the first response was, its an old building/machine there is nothing we can do about it. second call to them, they sent the hausmeister round who asked what the problem was and of course he couldnt help. i am seriously at the end of my tether after having only moved in a few of months ago (with a 2 week old baby and get very little sleep to begin with) we have also been looking for other apartments and of course in the zurich housing market have had no luck so far.

please, please does anyone know of any swiss housing/rental laws of which would give us some kind of leg to stand on which would allow us to take this further? or do we just have to keep looking for a new one....??

Contact these people (residents rights association), They'll able to advise you of what can be done, how to complain, etc. You might have to join but it's only 100 francs or so per year.
The heating system should be properly insulated to prevent noise and vibrations carrying into the appartment above, it's expensive, which is why the owners will try to get out of doing it, but these people should be able to help.

To be honest, there is not much that can be done. The machine tie is needed for all apartments and they can't stop it. I understand how annoying it must be.

Keep looking for an other apartment and hope to find something better soon enough.

Just curious, was this information disclosed before you moved in? I am guessing probably not but maybe this could be a good reason from your side for legal action or getting out of your contract.

thank you all for your replies.

i phoned the verwaltung again this morning after only a few hours sleep i was at the point of breakdown ( and the lady i spoke to last told me that the hausmeister in fact called the heating man and there is an issue with a pump which needs replacing. however the lady who is responsible for our apartment is on holiday and the heating guy had a death in the family and it will take weeks before anything can be done. of course i thanked them at least for doing this much and im happy that it is in progress but i am not sure that this will eradicate all of the noise, but i remain hopeful !!

Puhutes, no it wasn't disclosed which is exactly what i said to them when i phoned to complain the second time and im hoping if it isnt resolve will give us as you say the rights to get out of the contract.

Hope the new pump is fitted quickly and you finally get some sleep,
a new baby is exhausting enough without additional things to keep you awake. Congratulations by the way!

Sympathy of course for the poor heating man, but if nothing has been done in a couple of weeks nudge them again about it. Fingers crossed.

We had a similar problem a few years back. IT was quite frustrating because they kept saying the noise is not so bad. But if one can not sleep that is bad enough. It took me quite a few threatening (legal) letters and about a months but finally they replaced a pump which caused the noise. So do NOT GIVE UP. You have a RIGHT to get a good sleep in that apartment. Otherwise they are not allowed to rent it as living space! What I did was (might not be an option for you. I was lucky that the heating room was not locked up) is that I reprogrammed the timer of the heating system so that I can get at least 6h of sleep at night. Nobody noticed as it was in spring and heating has quite a hysteresis as far as cooling down goes. After the pump was replaced, I set the programming back.

EPMike, you've given me hope
i have to tell you, had the door have been open........and believe me, many times i've envisaged this....i would enter with a hammer and smash the thing to pieces (ive even thought about the consequences of this and thought that cold showers wouldn't be such a bad thing ), not having a lucid mind due to lack of sleep have not even contemplated reprogramming, a much more sane thing to do. I will see if this can be done in the mean time !

Agreed! I feel your pain with a 2 year old and a REALLY noisy elephant living upstairs. My best friend = Ear plugs

Since this is a recognised problem, which is affecting your health (lack of sleep can lead to serious health problems, not to mention the safety issues of using anything while overtired), you might be able to convince the landlord to give you a rent reduction for the period while the noise has been disturbing you - if you check with the renters' association (Mieterverband), you may find that he is legally entitled to do so.

You should be pushing for between 50 and 100% rent reduction until this is fixed. Document all communication, get the mieterveband involved. If things don't work out then insist to leave the apartment without notice period.

I have exactly the same type of noise that you do, this rattling annoying resonance in the walls which just hammers your head!

Did you sort it out? I am still in the phase of even knowing the source of the noise... but any hints on how things went with you would be helpful.

update !! after a few more complaints and threat of legal action from my side...... to cut a long story short they eventually replaced the noisy pump .

In order to do this they had to collect a few quotes as the work was 5kchf + which needed to be decided upon by the owner (all in all took +4months since our first complaint, 2 months since I became increasingly pushy advising that i could not live with the noise).

i thereafter requested a reduction in rent in writing (as advised by the verwaltung) for the time that i spent living or should i say existing with that racket which i had to endure for the four months.....so little sleep etc etc - and wait for it, they offered us a meager 500chf.

I am really not happy at all to accept this but seeing as though the noise has now been fixed, not sure how I can prove how disruptive the noise was in the first place and taking into account the legal costs/hassle etc don't know whether to just cut my losses??!!

oh yeah and because no one else in the building complained (which i know to be complete bull&%*%).....this really made me laugh.....anyway seeing as though our apartment is the one and only above the heater room that does not justify anything surely ??!!!

Well, I must say that you are really lucky that they actually decided to fix it.

We are going through exactly the same process atm. We have three rooms and we can barely sleep only in one of them (which is not a bed room) because of the annoying pump. Unfortunately the owner is a scrooge and says that we should get used to it (even though he came and admitted that the sound is annoying).

I think we will go the hard (legal) way as it seems that being nice does not really do much good. If you have any tips i would be grateful (pm is fine).
