Deposit return and the one year rule

Dear EF friends,

Apologies for "yet another deposit return thread". I spent the morning looking at past discussions but couldn't find anything useful, so here I am.

I have read everything about getting the deposit back from the rental deposit bank account and the one year rule, but still some things are not completely clear to me.

One year has just passed since we left the apartment and my wife and I went to the bank to release the deposit. We called ASLOCA which told us to just bring to the bank the leaving documents ("Etat des lieux") to demonstrate that one year had passed. During this year, we have received no legal claims from our previous landlord. Moreover, the apartment was sold just after we exited (this may be an irrelevant though, but still...).

However, with our big surprise, the bank told us that, despite one year has already passed, we still need to ask the landlord to release the money. They said they would send a letter to the landlord and wait 30 days for an answer, and only after they would proceed to release the deposit.

I'm very confused now, because this goes against everything I've read so far, and goes against what ASLOCA told us too. We have already scheduled an appointment with ASLOCA but it will be in one month, so kind of useless for the moment.

Does anyone have some suggestion?

Yes this is how it works. It is actually 13 months that it finally gets to you. After a year the bank will send a letter to the landlord to find out if any claims are pending and wait another 2 weeks for a reply. Then they should clear it.
