Which months to give notice?

Hello

I've been trying to find the thread where it says that people officially give their notice on apartments, but couldn't. Can someone advise - is it January and July normally?

We can leave our appartment twice a year - end of March and September with three month notice.

You need to see what your contract says.

Mine is end of March, June or September with 3 months notice. Alternatively, you can give minimum one month's notice if you find a replacement (who is financially able and willing to take over your apartment with the same conditions).

Only what is written in your contract is valid for you. Assuming you have an existing contract... otherwise, it varies quite a bit....

Thank you all for your responses, it is very much appreciated!

As I have yet to move to Zürich, I don't have a contract - however I was just wondering if there were set months in which people normally give notice on their contracts, as this has been the case in other cities in which I have lived.

Generally three months to the end of the quarter except for December.

Unless you live in a total dump, you can get around this by offering up a suitable tenant to take over.

Agree with other responders, that EF is slowly getting swamped by "too lazy to use google/read contract/ask my HR department" questions.

Most times it will be written in your contract. If nothing is written the "customary moving dates" will apply. However, these are different in the various cantons. It is probably easiest to check the local renter's association websites for information (www.mieterverband.ch) or to contact one of the conciliations boards.

Well, to be fair to the OP she/he had very specific question, i.e. which local standard notice periods will apply. The "three months to the end of the quarter ..." does not apply everywhere in Switzerland.

Err no. It was a very generic vaguely formulated "OQ" question with geographical precision only in a subsequent post. She also got the answer that is relevant 90% of the time in CH: you can get out of any lease quite flexibly by showing your flat to a few people and offering up, at worst, three suitable tenants.

I'd check out that 'three suitable tenants' bit.
Terminating a tenancy agreement from our old friend, www.ch.ch who really should know the right answer.

I appreciate that offering more than one name is safer - sometimes a prospective new tenant is turned down as being really unsuitable but, according to the above link, the law says one.

If searched for Kündigungstermine+wohnung, you will find it is 3 months minimum, with resources like this.

Appreciate your patience to have responded, it isn't that I wasn't sure on the '3 months' notice (and of course I would validate/confirm my contract with the landlord, when I get one!) I just wasn't sure if there were restrictions/limitations on which months you could give your notice.

Clearly it only needs to be one suitable tenant, but its the landlords decision what constitutes suitable, although there are guidelines for this (it is Switzerland of course): solvent, "gute leumund" ie reputable, will take over on the same conditions, and "no disadvantages compared to the current tenant" which apparently means say if you were renting as a married couple, he cant declined unmarried couples, couple with kids if there is room in the flat, foreigners (except asylum seeker), but could refuse professional musicians or pets... that are likely to cause a nuisance. Where the landlord lives in the block the criteria can become more subjective.

I looked this up in "Mietrecht" from beobachter.ch 2010 edition. Could be a question for the Swiss QI show...

I have read through many treads regarding giving notice...

Our contract states we can give notice and move any time by giving 3 month's notice except for December.

My question...Does this mean we are not allowed to move out in December but December can be part of our notice period? i.e give notice 1st December to move out 28th Feb?

Apologies if I missed the thread where this was answered.

My guess would be they don't want you moving out in December, because it will be harder to find a replacement to start then. i.e. people not wanting to move in around Christmas time. But I could be wrong.
