Deposit return question

Hi!
When you rent a flat in two, give the deposit together to the real estate agency which puts it to the bank and sign both the document for it, the bank will not give the deposit to just one party, it makes sense. But what can I do if my ex-husband disappeared fully without contact to different continent and more than one year we didnīt see him? Does it make sense to hire a lawyer for it or would it cost more than 3 thousands and should I rather forgot it?

did you both sign the document? Did you or do you have power of attourney in financial matters? have you tried contacting the agency to get this deposit back?

I thought if you were married then one can sign for the other in matters of "daily life"? Does this not include rental deposits? Did you tell the agency the problem? Maybe they've seen this situation before and know what to do.

Thank you for your interest. I tried to contact the real estate agency many times and spoke with different people but they told me that both have to sign otherwise bank will not return. There are 2 signatures on the document, mine and my ex.
Actually we are not divorced yet, without his presence we can be divorce after 2 years from separation and there is still half of year left.
