rent depot, into the landlord's account?

Hi everybody,

I need help / advice on the followinbg situation, maybe some of you have more experience than I do.

I have lived in Zurich for 6 months now, in an apartment that I need to leave next month. I have found a new place, great and all, and I have alread signed the contract. It says that I should put the rent depot in an account at my name and pay the first month's rent before moving in.

So far so good. However, the landlord insists that the depot should be payed to his personal account, claiming that he will later transfer the money to my rent-deposit-account. I don't see the reason. Do you think that's usual? Has that happened to anyone of you? Or has everybody just payed the depot to their own accounts and then handled the certificate to the landlord?

Sounds slightly off. Both times we've rented apartments here, the rental company has opened a brand new account, just to hold the deposit. (Both with Migros bank, co-incidentally). The new account has both our name & the landlord's name as joint signatures, so neither can just disappear with the money.

Absolute no-go. If in doubt, go the the bank and open your own account - explain that it is for rent purposes and that it should be blocked, unless released by the landlord.

The landlord explicitly said he won't accept something different that this way. I give him the money, then he transfers it back to our account.

Your landlord may not receive the payment on his account - smells like someone who is trying to take advantage of you..

Your landlord is asking for something that is illegal in Switzerland!

The Swiss law specifies a blocked bank account in your name! He can choose which bank.

Are you being scammed? Have you actually been inside the apartment? Have you met the landlord?

Do not give any landlord any money! Insist it goes into a blocked account in your name!

And YOU pay the money into this account and show him the receipt, or walk away from this deal!

I have visited the apartment, but haven't met the landlord personally. I am not sure if this is serious or not...

Does it make sense a fraud where they give me their personal bank account IN Switzerland? Sounds like every transaction will be registered...

Bank accounts can be closed and the money taken out of Switzerland while you are happily working away to pay the rent.

Do not be naive, this is probably a scam, if you visit a property selling agent they will give you the keys and you view the apartment normally by yourself.

How did you access the apartment? Did the "Landlord" tell you to collect the keys from the agent?
It might confirm a crime, if you ask the agent for the correct name of the landlord, and then compare the two names....

You might want to report your experience to the police!

No, he isn't.

What the OP's landlord wants to do is perfectly legal, if not exactly customary these days.

In practice the tenant has to sign some papers to create this locked account, so it's customary to transfer the funds directly at that time. Nothing says it has to be done that way round though: what the law actually says is that the landlord, if he receives a deposit, has to put that deposit into a locked account in the tenant's name.

Which is exactly what the OP's landlord proposes to do.

If the contract really says that you should transfer the money into an appropriate locked account (rather than simply "the money will be transferred") then you're well within your rights to insist on doing it that way. Check the wording again and see.

We have done this recently, as we were dealing with a private landlord. Our landlord gave us a form to sign the day after he received the deposit, to order the money to go into a deposit account, which will then be locked. I think this is a fairly standard but old-fashioned way of doing this.

We paid at the end of feb, then got the keys March 1st. The landlord lives above us, so guess we knew who they were and had met them, so was slightly easier.

It's been a long time after the last post, but I just wanted to thank everybody for your help. Your advice has been useful! To let you know how the story ended, I payed the depot to the landlord's account, and he transfered it to an account at my name perfectly on time. We have rented the apartment and everything has gone well, so I guess it was just a different way of doing things.

Could you please keep this thread in mind for when you move out?


Fingers crossed the story ends well, but I'm of the impression that getting into the apartment was not going to be the problem.


To be fair, I've also rented a privately owned flat in Zurich, and had no problems on exit.... but there is still a massive potential for things to go wrong.
