Hauswart denying parking spot

Hi, I live in a town just outside of Zurich where parking is very scarce. My house has a couple of garages and a space in front of it which the residents use for parking (it is not marked as such). As I would like to park in this space, I've approached my Verwaltung who directed me to the Hauswart. The Hauswart denying saying that there is not enough room and particularly in winter it will be very tough to use.

As I strongly disagree and believe there is sufficient space for one more car, I am wondering what are my rights in this situation? Is there a legal way to dispute the denial or do I just have to keep trying to persuade the Hauswart?

Was the flat advertised with possibility of renting parking space? Or your contract?

They probably have to push all the snow to the side and back in winter, which will take quite a bit of space, as he says. What was it like last winter?

A parking space costs between CHF120 to CHF200 per month. I don't think you can expect just to have one because there is "sufficient space"...

Take the Hauswart a nice box of chocolates and ask him nicely if he knows of a parking space nearby, that you could rent permanently. If he says he doesn't know of any, ask him for the chocolates back!

If the space is "not marked" in front of the house, I guess everybody just parks their car as long as there is room? So why can you not do the same?

We have a similar situation in front of the house and if you get home too late - bad luck. (Or use a business parkplace across the street and hope they won't bust you.)

Many thanks for all the suggestions! I can't recall if a parking place was advertised (been living in this building for almost 3 years now), but certainly no mention of it in the contract.

I'm ok to pay if need be, but at this stage I'm getting just an unconditional no.

I guess I can just try park like everybody else but don't want to create any tension. Will try the chocolate box to the Hauswart plan first...

Not particularly. It's an open asphalted area in front of garages. There are two yellow rectangles painted but people park outside of them no problem.

Oh, then it may be a misunderstanding them. The 2 yellow places are

- either already rented by someone
- or meant as "Besucher" but was never painted on it.
(I think the Hauswart should tell you which case it is)

And the rest of the space do not count as official parking places... unless there is a particular pattern that you always see the same cars always parking to the same location I would not really worry much.

Technically, if you park there anybody could report you for parking at a non-parking area. (Ok you probably get a 40 CHF fine.) But do you think any of your neighbours would that, because they do the same on a regular bases don't they?

I think the Hauswart said no to you because he probably thought you want to rent a space only for yourself, and he prefers to keep the "common area". And those 2 painted ones might be taken already - the rest of the asphalt he may want to keep open for fire security or similar reasons.
