The getting screwed by your landlord thread

Others have posted on this subject in various threads - let's put then all in one thread.
Here is my latest episode of getting screwed. I live in a row house , 1 of 6 identical to each other. My jahresabrechnung fpr 2013 shows a shortfall on the nebenkosten paid of 600chf.
This is due to excessive heating bill. I have been asking the private landlord to fix our heating thermostat for 2 years. It was replaced last week and we can now control our heating. We can actually turn it off!!
The landlord wants me to pay the extra 600chf for heating caused by a failed thermostat which he has only just fixed.
Should I pay or should I state it is his fault for being slow to repair??

tbf, you can't always leave when you have an issue like this. plus finding new accommodation and moving is a huge hassle

Personally I want to feel calm and safe where I live and not abused. Even with the smallest abuse from landlords/employer etc I tend to take the risk of leaving than dragging this for months or years.

They will never change and you only live once. Not enough time to deal with problematic people. But I realise it's hard to move of course. If this is the only problem for the OP in his stay there it's not a big deal.

Afraid you have to pay…

we had something similar quite a few years ago - we rented the larger section of a house which was being newly renovated but the owners failed to renew the electricity counter (thought it was too expensive) and did not tell us - so we carefully did our laundry etc. during the "Niedertarif" hours only to find when we had to pay the bills, that it was irrelevant since we had an old box that was not able to differentiate between the normal and the lower tariff - on its own, this would probably not have been too bad, but the owners were generally not reliable - we did not stay long...

Two years is a very long time to ask for something to be repaired, particularly heating. I fail to understand why you did not escalate the matter. Seriously, mainly landlords do not take things seriously until you take the matter to mediation. It's a process, a slow one, but as soon as the landlord does not get his rent (you pay it into a special account) he seems to be able to focus better on the problem.

Now the problem as I see it is that you cannot prove what the heating costs should have been right now.

Tell the landlord you will pay him in 2 years. Then you have time to see what the heating costs actually are.

Of course you could still take the matter to mediation but I hope you have a pile of registered lettters to the owner about the problem to prove how long it has been broken. Do you know the cost of the thermostat repair?

I feel your frustration. Did you make the complaint in writing, re registered post- once you realised they were not doing anything about the thermostat?

I know- I bet I wouldn't have either- and yet, if you had proof of your complaint re thermostat and request for it to be fixed, you'd probably be off the hook. If I was a tenant, I'd certainly join Asloca/Mietverband from day one- and ask them for how to proceed, with complaints, and now with this unfair situation

Be lucky you have a thermostat at all. We don't and got a whopping 1500CHF for the year to pay extra last year. Not had this year's in yet.

Also the shutter that hasn't been repaired for over 2 years, our mold problem that they refuse to remedy, the old bat downstairs that keeps knocking on the ceiling when anyone makes any noise in our apartment.

And when I complained about this all what happens? They terminated my lease

My landlord is a fine fellow. First time I have ever rented a property (always have and still own a house in the UK). Get on well with him and he responds to issues we have (only 2 so far) with speed and without question.
Now the letting agent , that is a different story. She took 4 hours to hand over the apartment and even got me to kneel in front of one of the toilets and at the correct angle, when the light reflected off the toilet lid you could just see a small scratch on the plastic lid. However the best bit was when I said "Whats the crime rate like in the area ?".....oh none she said ...None I said ? Well if you leave your property unlocked you might get robbed. O.K.
Anyway after 14 months we have had two robbery in our block of 14 apartments.
The cherry on the cake was Wednesday night. I wanted to see if I could find a picture of the apartments being built and used Google Image and taped in my address. The first picture to pop up was one of the block with half a dozen police vehicles parked outside ??? so I clicked on link to web page image was found on and the read about the Double Murder in the top floor apartment some 5 years ago :-(
Guess the agent forgot to mention that.

Blimey, our house is a bit of a (lovable) monster- but last year was just less than 3000 and we are high up in the Jura.

The other day in the Neuchâtel neswpaper- the story of a Swiss couple, born and bred in Neuch- whose lease was terminated because of regular complaints and the refusal to pay a heating bill for about 400CHF they thought unfair. So it does not just happen to foreigners.

Fair or unfair, at a time when the rate of occupancy is so high and competition fierce- landlords can and will (often unfairly) push the limits- knowing that there are plenty of tenants waiting out there, and prepared to pay. Which is why I would always make sure that I am an Asloca/Mietverband member for advice as and when needed- and also subscribe to a consumer magazine which gives free legal advise to subscribers (Bon à Savoir).

Who mentioned it only happening to foreigners?

Although the letting agent did say in court that my problems with mold were due to me not being used to living in countries like Switzerland. The judge wasn't impressed and reminded him I'm from Scotland and that I'd lived in a Swiss apartment for 3 years before with 0 problems.

Regardless I was out of lease so they didn't need any reason to terminate my lease.

we had some leak in our building (not our apartment) in August.
to find the cause of the leak, they had to break in our bathroom wall.
twice, some guys were there to do the work.
they were very polite and cleaned everything up.
nearly forgot about it until last month, we got a letter that we got 500 CHF back from our rent because of the trouble.
Very positive experience.
