[working with] agent vs landlord

hi
I have a question
we are planning to buy an apartment here. and checked comparis, then found one with real estate agent contact.
we contacted him then he arranged the visit of the house. but he is actually not very active.
then after several days we found that the landlord loaded the information again by himself with all his own contact info.
we are quite interested in this apartment. but now we do not know what we should do?
is it normal here that the landlord just skipped the agent like that?
and can we now just contact the landlord directly without noticing the agent?

An apartment can be privately advertised as well as with the estate agent. the difference is if you go through the estate agent, the seller will pay a fee, so you may see a difference in the prices of the adverts to compensate for this.

Did you sign a contract with the agent? If not then I'd assume you can safely go directly with the owner. However, the owner may run into a problem listing on their own, depending on the contract they've signed with the agent. Proceed with caution.

You can buy from whoever you want as it is seller who is responsible for the agent costs (Canton Vaud)

(maybe different in other cantons as notary fees are !)

we did not sign any contract with the agent, but we really worried if we contact the seller self directly and once it gets known by the agent, will it bring any trouble to us? ;(

Normally an estate agent gives you a contract to sign so you know how much his commission will be (between 2.5 & 3% in Geneva) depending on whether the contract is exclusive or not. They send you confirmation of who they have given the details to of your property & when they show someone round, so if various agents are involved there is traceability for the commission.

I think the only person that could get in trouble would be him, IF he violated the terms of agreement he signed when signing up for the agency. When I moved to Zurich last year, I used an agent (UMS) and it ended up being quite expensive (I believe roughly 1.5 month commission), so if you could sign a lease without involving an agent it would be better for you. I'd be wary though - I think the best way forward is to ask the seller what happened with the agency and go from there based on his answer.
