Two Apartments [being blackmailed]

Hello Everyone,

Is it illegal to rent two apartments in Geneva at the same time? What could happen if both the régies discover about it?

I have two apartments, one is where my mother is staying. My mom is retiring in 3 months, will be going home for good and the apartment will be given up after. Apparently my ex boyfriend is threatening me that he will expose me with both régies.

Now I am worrying because my mom lives there. Am I going to lose both apartments? If so do you know good lawyers that could help me with this? Thank you for your help..

You can rent as many as you like, but you can only be registered at one of them.

Your ex boyfriend is obviously an ex-boyfriend for a reason? What does he want from threatening you?

Does the owner know that your mum is living in the apartment? Registered properly, and how long has she been there?

Anyone can be your 'guest'... There are some vague rules about occupancy (not having too many people in one apartment)...

I cannot see what the problem is... You rent two apartments and you pay rent for both.... You are not subletting illegally if your mum is your guest, or is on the lease, or you have informed the landlord, and you are unlikely to have major problems about it unless your mum is paying you high rent.

I assume that you either want to let the apartment go when your mum moves out, or to sublet it to someone else. Normally you need permission to sublet...

Thanks for your reply. It's quite a long story about my ex.. He wants me to provide him a document so he could make money out of it so he could finance her new girl (he cheated by the way), which is not fair for me so I refuse. Now he's blackmailing me.

Regarding the apartment, it was actually rented be her employer for her then when I arrived to Geneva they transferred it to my name, so the owner knows that she lives there, and she is alone in the apartment. She is paying only the actual rent in the contract.

My worry is, if my ex writes to both of my régies, are they going to take one or both of the apartments? Will I be sued or penalized?

Hi, thanks for your reply. What do you mean registered? Did you mean registered to the Cantonal/Govt? If so yes I am registered to where I live now, but I am renting two apartments in my name..

I can't quite follow your thoughts. You can rent a hundred apartments if you want and if you can afford it and pay your rent on time every month. No one will care and no one is going to take anything from you, cause why would they? And what would you be sued or penalized for?

The only obligation you have is to be registered with the commune on one address in that commune. Apparently, that is the case. Everything else is your personal business, and there is no need to worry about it.

Thanks, that's great to know! It's just that I am not too familiar with the Swiss rules on apartments and I've been hearing that it's illegal to rent more than one apartment. This sucker is trying to put stress on me!

Your Mum is retiring in 3 months and going home (I assume soon after she stops the job). You/she will have to give notice of leaving very soon I imagine. Problem solved in terms of having two properties rented.

In terms of the ex, try really hard to ignore his threats and withdraw as much energy as you can from him - hang up the phone straight away if he calls and threatens you, etc. Don't try and reason with him as that just feeds his need to be in your life and annoying you.

Enjoy the rest of the time you have with your mum in the same city.

That would be a great idea! He's actually giving me a deadline to send him my document (I know, he's unbelievable) and that's exactly what I will do to him!

That was my doubt earlier because I have 2 apartments and I was afraid that if I go to the police it might go against me. But since I knew that I'm safe, I think that's an option now.

Ok dears I think I'm gonna need your recommendation for a good English-speaking lawyer, please! Can the RC insurance cover the lawyer fees? He's really pursuing to make trouble, I might create another thread to tell the story..

If he is harassing you or attempting to blackmail you or threatening/intimidating you - go to the Police.

Why did the employer transfer the contract to your name and not hers if they arranged the apartment for her in the first place? She can obviously afford the rent so it shouldn't have been any problem in putting it in her name?

He can't blackmail you unless you let him. Tell him to go jump off a bridge because you know there's nothing illegal about what you're doing. And do report him to the police if he keeps trying.

Ok there's something else that I didn't mention yet. My mom does not have legal paper here, although she has AVS and she's been here for long time. And that's what he's going to expose aside from my 2 apartments. He plans to write to my employer too about them. I also have insulted him through text (my mistake) and he said he's gonna use it against me.

Ah, so the real story comes out now. It's not about two apartments, it's about your mom's status not having a permit. That is a tad more tricky, but I still say you don't owe him a damn thing.
