Help! Can someone tell me what this means?

This part of our lease refers to when and how we give notice. What exactly does it mean? Seems only twice a year possible, 3 months before or after march or september?

MIETBEGINN UND KÜNDIGUNG
Beginn am 16.09.2012 mittags 12 Uhr
Kündigungsbestimmungen 3 Monate) im Voraus auf Ende März und Ende September
frühestens auf 30.09.2014
Die Kündigung durch den Mieter hat mit Einschreibebrief, jene durch den Vermieter mit amtlichem Formular zu erfolgen. Sie ist gültig, wenn sie Spätestens am letzten Tag vor Beginn der Kündigungsfrist bei der Gegenpartei eintrifft oder bei der Post abholbereit vorliegt. Für die Kündigung von Mietverträgen für Familienwohnungen gelten die besonderen Bestimmungen (Ziff. 13A) in den Allgemeinen Bedingungen zum Mietvertrag für Wohnräume. Bei ausserterminlichen Kündigungen ist deren Ziff. 13B zu beachten.

You have to give three months notice to terminate on either March 31st or September 30th so the notice has to reach them by registered letter at least three months before that. The letter ( or the post office notification for delivery of the letter) must reach them at the latest by the last (working) day of the month preceding the notice period so by 31st December or 30th June.

To end your contract outside of these dates you need to refer to article 13B. ( which I guess says you need to find a suitable replacement tenant)

Also your lease cannot be terminated before Sept 30 2014, so the latest your first possible notice should arrive at their premises is on Jun 30 2014 if you want to terminate the lease on Sept 30 2014.

Are you sure you've got those dates right OP? As 2014 is over, is this a new contract?

Well the contract began in September 2012 so I assume they had a minimum two year lease which could not be terminated before September 2014.

Since that date had already passed I didn't bother translating that bit.

The contract has no end date but a minimum of 2 years after Sept 2012.
After Sept 2014, notice periods are pretty standard with 3 months and the two possible dates in a calendar year.

Most contract works like that
If you leave on those dates you don't have to find new tenant if you leave on another date you have to find "Fit" candidates. and pay for homegate ads etc..

Not much of a choice there
