Who's responsible for the damage?

We own our own property which has a large concrete wall that runs down one side. We own the wall and the land on the other side of the wall (about 1.5m wide), then there is a wanderweg and finally a very steep bank to the limmat.

A couple of weeks ago the city started work to replace some pipes under the wanderweg and began digging everything up. They start at 7 am, have made a huge mess, make a ton of noise - whatever that part is fine, we can deal.

Today they started ripping out trees by pushing them over with a backhoe. And then pushing them and dragging them along the wanderweg. The trees were coming over my wall, that's why I saw the commotion. The trees were falling at all angles not being controlled, and we are quite upset they have taken away so much green - but the trees are on their side. In the midst of all of this - they have damaged our wall in multiple places, and have completely ruined the grass on the other side of the wall for a stretch of about 150m. No one has approached us about all this, but I have photos and a video of the tree disaster.

So - who do we call? The bauamt? The construction company? My hubby bumped into the neighbor and he is also really upset by all the trees coming down, but he doesn't have a wall like we do thus no damage.

Has anyone dealt with a similar situation? At the very least they need to patch up and repair the wall, and we should be compensated for the grass or they should hire a garden company to lay sod. Suggestions are more than welcome. Thanks

I'd call your insurance. That is what you pay them for so they can get intouch with the company responsible for the damage.

You could also request from one of the workers to get the contractors info directly and discuss with them.

Continue to document everything with video and photos , even as they are working. And I'd hurry up with contacting people so they cannot claim later on that it was like that.


My rents have a "wanderweg" also but own it. It is only accesable for farmers going to their fields. After years of destroying the road and mud berms 50 cm high we talked to them. Now he runs a scraper by every time planting/harvesting season is over

I called our gebaudeversicherung company today and they told me that we will need to take it up with the construction company.

Plan to try and catch the site manager tomorrow morning :-/ let's hope.

I assume the Gemeinde commissioned the request, so they are ultimately responsible.

This may/will become tricky, so be prepared. And again, document everything (photos, films)

We contacted the gemeinde and they are well aware of the situation, apparently quite a few neighbors have complained.

They said they have before pics of the wall and grass and will repair everything, including laying sod. We also have pics and a video to back everything up. They also said they were going to replant the trees, but had no idea why they were being torn down. Very sad to see such beautiful trees pushed over with a backhoe.
