Agency provided wrong information in the contract

Hello Everyone,

We are living in Basel for almost 7 years. Initially when we rented the flat it was told the space of the flat was 57m2, now when we are moving out, in the new application forms they have mentioned it as 45m2. After double checking with agency, they have confirmed it as 45m2 and they didn't bother to explain why?

Though it didn't impacted our living, my question is, Is it ok to provide false information? They talk about rules every time and being precise in everything.

Could it be that the higher figure comprises also the total area of the flat plus the cellar, balcony or terrace perhaps?

I know that on some documents for flats the inside area only is mentioned and the balcony is listed separately, whilst on others the balcony area is included in the total.

Yes, rest everything mentioned as separate. The space they are talking about is only about the inside flat.

Do you have any sloping ceilings by any chance?
Floor area could referring the total space, but the new, lower figure might then be the actual livable square metrage (there's a minimum permitted head height for livable space which varies slightly from canton to canton).

The new, lower figure, may have an impact on your auxiliary cost (Nebenkosten) bill. You may be entitled to an refund if part of the bill is calculated and distributed according to floor space.
