subrenting an apartment

Me and my gf have planned to to move to Zug kanton from Zurich.
We found an apt. and signed contract. Now my gf found a job in our area and now we are not sure to move. Can we sub rent the apartment to someone ?
Should this be agreed with landlord?

The best way would be to ask the landlord directly as different rules may apply for different landlords. In my case landlord provided their own contract for sublease and did not have any issue with it.

Check your lease, normally landlords state that they must agree to subleases for them to be legal.

The landlord can refuse subleases under very rare circumstances, but you need to inform him of the sublease before it starts or you risk him ending your (and thus the subletter's) lease.

I believe that landlords have very limited means to reject subleases, for example if you charge more than 10% in excess of the regular rent...

1. you are free to sub let the apartment, a copy of the new sub let lease must be given to the landlord for his approval. Do not expect to make any profit!

2. be aware that a sub let lease does not get you off the commitment. If the sub tenant defaults in any way, YOU are still responsible until your lease has finished, and your sub let tenant will know this! So resign your rental contract, or lease, as soon as possible.

3. ask your landlord for advice. If you provide someone who is willing & able to take over the lease, the landlord cannot legally refuse. But he might prefer to let you cancel your lease so he is able to choose the next tenant himself.

4. any sub tenant must have a clean debtor's record (Betreibungsregister Auszug) and earn a salary that is 3 times the rental.
