Sub renting in a WG

Hi all,

I live in a WG with two other flatmates. We actually sub rent to somebody who does not live there.

We are leaving the flat and were thinking to (sub?) sub rent. Is this legal? Can the sub renter reject it?

Any info is welcome.

As you live in a WG I have to assume you have little money. What will you do if the sub-sub tenant decides not to pay you? Or even changes the locks or disapears? I would strongly advise against any futher sub letting. Just try and keep things simple and always in writing. Really!

If you have someone(s) who wants to rent it, just put them forward to the (sub?) landlord as a replacement. Unless they have a good reason for rejecting them you should be fine to then give notice for the swap.

IMO the landlord and the tenant who you are renting from both have to agree to your subletting the place to someone else, as the landlord has the last word on who lives on his property.
