Nebenkosten [additional rental costs]

Hello everyone, unfortunately are having some issues with our landlord about the Nebenkosten. I've read a lot of the posts on EF and saw a recommendation for https://www.mieterverband.ch/. I called the office for our canton but communication in English was difficult. Today I found another site http://www.mieterschutzverband.ch/. I am wondering whether any EF members have any experience with this other agency and know how it is different to the official office that everyone recommends? Thanks so much for your help.

I looked in ktipp.
K stands for "Konsum" and this organisation publishes a magazine about consumer issues. Amongst many other things, such as product tests, they also maintain a list of companies about which they receive a lot of complaints (= from people who feel they've been treated unfairly), and "Mieterschutz" is on that list.

"K-Tipp-Leser zahlten jahrelang versehentlich Beiträge an die Mieterschutz Schweiz MSS GmbH statt an den Mieterverband. Als sie ¬Auskunft wollten, kündigte die Firma fristlos."
K-Tips readers accidentally paid for years contributions to the "Mieterschutz MSS Switzerland GmbH" instead of to the Mieterverband. When they wanted information/advice, however, the company simply cancelled the contract without a notice period.

Note here that Mieterschutz is a "GmbH" (= a business), whereas the Mieterverband is a not-for-profit organisation protecting the rights of tenants.

Wouldn't it be so much better if Nebenkosten where part of the rent here!!! so you'd know what the full rent will be stupid!

Well how can they possibly know how much heating you will use? Perhaps you don't realise in CH things such as heating & hot water are shared. In the UK thats unusual but not impossible.

If I am a single person living in an apartment block it is not fair that I should supplement my nebenkosts with say a family of 4 that that use more heating etc than I do!!

There would be no motivation to save water/heating etc if it were already paid for...

It's either based on the m2 of your apartment or in some cases a device fitted to each radiator to see how hot they were, so in reality your not subsidising them.

Life isn't fair!
We don't use the lift but pay for it. We keep our flat fairly cool. When our children lived here we certainly used more hot water. Some people here don't ever use the 'communal' washing machine or tumble drier. They still pay their 'part' when the appliances have to be repaired or replaced. That's the way the cookie crumbles.

This is how they do it here.

To have an individual system for each apartment would be prohibitively expensive.

Over m2 any way doesn't really matter if you're alone or not, in fact a family of 4 probably use less energy than you alone as their body heat would contribute more to the heating.

Get you- perhaps water and electricity could have a basic 'average' charge- and those who use more pay extra. Never been a tenant in CH, so must say I am not totally 'au fait' as to what 'Nebencosten' are, I admit.

Thats in theory what happens, you pay on account what they estimate your charges will be & when final accounts are made up you either get a refund or pay extra.

What may surprise many is final bills do not need to be sent for 5 years. I rented a flat in ZH for about 15 years, the 'on account' never increased so I did always end up paying extra.

Body heat?? We are not bivouacing on K2!! As for billing each apartment or house they they seem to achieve that in the Uk

Our problem is that our landlord is treating the Nebenkosten as part of our rent and won't send us the invoices from the providers even though the rental agreement says we need to reconcile the invoices each year. We've lived in our standalone house for 2 years and paid a fixed amount for heating and electricity and water over that time but don't know what we have actually used. Our rental agreement expired without notice a few months ago. It all seems very complicated. Fingers crossed it will be easier in the UK.....

It may be based on the area of the respective apartment but if the neighbour decides to turn up every thermostat to full whack as they like their place hot then you'll be subsidising them if heating costs are shared.
