Where is my security deposit?

I signed a contract with an agency but left after 2 months. The agency very well knew when I was leaving for another canton, but they had to reschedule our appointment for a new candidate and contract.

The apartment is split between 3 people. I, the roomies and candidate signed a letter stating the candidate could take over my contract and I would be returned my deposit.

I confirmed with the candidate and agency that everything went smoothly and a new contract was made. After I contacted the agency, they said I had to sign some forms in order for my deposit to be released and would be mailed to me.

It's been nearly a month since I've heard back from the agency. I've tried several times to email them asking where the forms are but no response.

Why are they delaying the process? Should I just pay them a visit?

It can take a year to get your deposit as they can't be sure of final costs until all the bills are in.

Yes, thank you! I am aware of the one-year hold, but the agent never mentioned anything about a hold, especially when I was only there for 2 months.

Well the law applies to everybody, why should they make a big effort for someone who only stayed for 2 months, seems counter intuitive to me.

The normal way it works with a straight-forward rental deposit is that you do the check-out, the agency/landlord notifies you of any problems along with an estimate of costs.
They are then legally only allowed to retain the sum mentioned in their estimate for a year, not the entire deposit.... but they don't expect people to know this and certain agencies are notorious for dragging their feet about returning the rest.

You could also get a later bill for additional heating or water costs on top of whatever you'd been paying monthly, but that's not normally retained from the deposit.
Join your local ASLOCA /Mieterverband, it could save a lot of trouble later.

Sadly me and ASLOCA are going to spend a lot of time together, their appointments are far out though as there is not enough supply for the demand.

I was told if the charges where not enough I would not be held liable for the extra, but given all the problems I have had who knows if this is true

Yes, of course the law applies to everyone. But the person who took over the lease also paid the agency the same portion of the deposit as I. In that case where someone pays the deposit, do you still have to possibly wait a year?

Yes but then the new person might be paying extra for your hot water & heating costs, I doubt they will be happy with that.

I would be surprised if you weren't billed for your share of any excess (the size of the apartment divided by the number of apartments in the building) as you've theoretically used the heating/water, etc. but the specific details should be mentioned in your contract somewhere.

I see you've been having a lot of problems with your rented place recently.

Have you tried ringing them? Sometimes a phone call is harder to ignore than an email. Do you have anything in writing saying that you needed to sign a few more forms, if you can you could pop in with a copy and 'remind' them that you're still waiting.

I was told if I over paid they would refund me but if I under paid it was their problem. I am not sure if it's in the lease, I need to try to see, it's in French and not the easiest thing to translate. If I was lied to I'd not be shocked by now

If your still living there they have 5 years to invoice you, if you leave they have 1
