"Nebenkosten" - any one else had problems ?

Hi,

we have liked in our appartment for the last 5 years which we moved into them straight after they were built. Strangely in the first 3 years we did not get a bill for any extra costs for the appartment. So last year the first bill arrived for the first year that meant we had to pay a few hundred francs on top of what we have already paid as part of the monthly rent.

Last month we got the bill for 2005-2006 and now we are expected to 1500 CHF on top of what we have already paid as part of our rent and a suggestion that we should pay more each month towards the "nebenkosten". Which as one our neighbours mentioned is an undercover rent increase. Talking to our neighbours they have all written to W**casa to complain.

It seems you are allowed to send out bills up to 5 years later and the person has to pay. I am now thinking if I moved out tomorrow how large would be the will they would expect us to pay 4000 CHF ?

The rumour is that when the flats were rented they were put on the market at a price less than what they could have charged in order to get people to move in and so now they are trying to recoup the difference by charging much higher "nebenkosten" than we would have expected.

Has anyone else experienced problems ?

When I moved out of my last apartment I was met with an extra NK bill of 800 Francs (3 years). But, I was only paying 60 a month for NK and the real landlord died while I was there and her husband had to tidy things up. However, he did back it up with paperwork from the various heating organisations, etc.

Afraid I don't know about what the landlord is required to do but if your place is heated by oil then it is possible that the extra NK could be quite high, but I wouldn't think in the thousands. Surely they have to present the relevant bills to back up any claim for extra NK?

Hi,

neighbours who like us have asked about the way the cost has been calculated have been told that they can come over to the office and look through the bills. A neighbour who took them up on the offer said they were confronted with 5 larger folders of bills which meant it was impossible to get a real view of the situation. Even the Mieterverband when they looked at the way in which they had presented the bills to us, said it was extremely difficult to understand and potentially we may be being charged twice for the same thing.

For anyone does not know you can join the Mieterverband(http://www.mieterverband.ch/) for 72 CHF a year and then use their services as many times as you need to.

I don't think that you should have to look through the bills at their offices, you should receive a photocopy of the bills that the Nebenkosten are based on as a matter of course.

I would write to the landlords asking just that - in a polite way. Say you cannot pass their invoice for payment until you have checked their expenses that the Nebenkosten are based on and as soon as these, supported by photocopies of the bills, payment will be made.

What does the original contract say? Does it say SFrXXXX per month "incl" or "excl" Nebenkosten (service charges)?

If it says inclusive NK, then surely this is a one-sided change to the original contract?

I do know that you got to check these bills of expenses to the landlord. We were presented with a particular one, and after my son checked them, he found that we were actually due a credit - the landlord had made an error in his additions/subtractions. You also are most definitely due photostat copies of these bills, for your own records.
