What was funny to me, I mean I actually laughed with astonishment, was when I asked the tenant to please give us the name of the builder or workman who did the addition to the roof of the patio, so that I can check credentials/ building permits, he answered, " I built it myself, I had someone form the building department come round and check it, they said that a building permit was not necessary". When I asked for the name of the official he said that he had forgotten it. I asked don't you think you should have asked us for permission first for all the alterations or at least let us know, he shrugged!

Maybe I am wrong, maybe in Switzerland a renter can build additions or make alterations on a property without the owners permission, but I pay the insurance not him. He must have climbed onto the roof to do some of the work. I thought he was certified handicapped!

Anyway, hopefully I can meet up with some of you for a drink in March, I'm looking forward to that!

Make sure you know when you have to give them notice by. Assuming the contract has a 3 month termination notice then you must send the letter registered post to arrive with your tenant no later than 31st December for a 31st March termination date.

Or would it be 30th September for March 31st, given that December isn't normally used for contract terminations?

Also if you're unhappy with what the tenant has done to the house they are under supposed to return it to you in the same condition as it was when the rental started.

And no, they're not allowed make alterations to the property without your permission. You own the property, not them. And I would seriously check with the commune/gemeinde admin office to find out if any building permits were issued - because otherwise you/he may be required to tear them down again if permission was needed and not granted!

A question from my side i got curious about.

I get the part where a home has to be handed over in original condition while the to be expected "damage" of normal use is to be accepted up to a certain level, this rule is the same in many countries. And a renter can be forced to undo changes.

However the Netherlands also have a law which states that if the change is a clear improvement the landlord has to accept it. (Think of windows in the roof which raise value and pleasure) All of this of course only when done properly and according to all needed permits and rulings. Is there such law in this country?

If not, OP can always use it in negotiations for if she would like the house earlier. (tho beware of what you say and write and document everything.)

The cancellation period does not change if one month is possible termination date or not.

I suggest to send the termination ASAP. This leaves room for failures and also gives the other party enough time to find something else.

I agree, the longer the tenant has notice to leave the less excuse they can come up with that they couldn't find anything. Termination notice periods are the minimum required, nothing to say you can't send the notice earlier.

Apologies I neglected to say that we put the Velux windows in, he screwed blinds into the frames, it doesn't look good, we will probably buy new windows.

I thought I owe you all an update, especially those who gave really valuable info. Thank you for your support. I was a tenant myself for many years , so I struggled with this. I am apologize for the tone of my earlier posts, I was so frustrated. I am still a little frustrated, but that's life!
So, I won the schlichtingsbehoerde mediation. The council was wonderful. I did hire a lawyer, so it cost a few thousand, plus hotels, flights etc. But I think it was worth it
I should not have worried, all the evidence was clearly on my side. I still had all the work done on the house, new windows, new heating sytem etc. I did one bad thing, i took photos, even though I did not share the photos and the tenant allowed it it was still classed an invasion of privacy. So I had to apologize.
Going back, the day before he mediation, I asked to look at the new heating system, I tried to video it for my records. They threatened to call the police but i fet o was going to be attacked. I was attacked by one of the tenants and so then tried to leave without completing the inspection. I was shaken but no damage. I was then asked by them to complete the inspection, but refused, I asked them zeveral times to call the police, and as then slipped by them blockiing my exit. The tenants called the police, I waited outside for the police to hear their story undisturbed by me. Outside the police told me that i should not have videoed. Really i wanted the video for my own protection. I guessed that I might be attacked as it happened with the last tenants.
At the schlichtingsbehoerde the tenants also had a lawyer and a representative of the mietverien. I was so nervous.
The decision was they should have left end of April. I had given fair notice and satisfied all the rules The tenants asked on compassionate grounds to extend for 3 more months as, despite the mass of rental immediately available, inthe village, nothing even closely compared to my house in terms of price or convenience.of terms. So i allowed a further 3 mknghs yo the end of June, in all they had about 9 months.
I made an appointment with HEV to do the protokoll and they agreed to the time. I gave them the extra weekend advised by HEV, as the end of June falls on a Saturday.

So wish me luck. They have made so many alterations to the house, I hope that the house is properly restored without too much damage.
The house is in a great village in Thurgau, a 5 minute walk to the regional bahn, shops, schools, ultra friendly people. I don't blame them for not wanting to move, its just idyllic
Where I live in the US is also amazing, probably better scenery, but I am so sick of Trump, so sick of greed and social injustice. I feel like staying makes me complicit, despite my involvement in protests.
The recent separation of immigrant children is a travesty of justice and the complacency of ordinary folk begers belief. I'm seeking sanity.
