Rental agreement ending Monday July 31?

Is it possible for a tenancy agreement to end on Monday July 31st when the next day is a national holiday (Aug. 1.)?

Ummm.. yes? If it ends end of July, that's 31st of July..

But don't forget that Swiss NEVER mind to talk about something. You want to stay till the 2nd of August? Maybe the new renter will only move into it on Friday (4th August) - and you can stay till then..

Or maybe they wouldn't mind moving in the weekend earlier, but you wouldn't have to clean the flat because of that (jackpot!) - go ahead and ask, use your mouth!

Why shouldn't it be possible? July 31 is a normal business/working day like any other. Just because August 1 happens to fall on a Tuesday this year - with many going for long weekends - doesn't change that.

My tenants have lived in our property for 8 years. We are getting ready for early retirement, moving back, providing somewhere for our boomerang daughter, who is at present dependent upon us, while she follows her pursuit to be a music producer. 😖 Actually she's very talented. I will post her music on The YouTube thread.

We have two alternatives:
1 Move back ourselves.
2 Let her live there

So I wanted to check on our house which we haven't seen for about 8 years.
The tenant pays about CHF1000 under the market rate but seems happy and by all accounts from neighbors takes good care of the garden.

The tenant has always been difficult to get hold of, but even more so recently.
Particularly he does not answer me promptly, perhaps because I am a woman.
I tried emailing for me to visit the house, but he replied that he cannot confirm an August appointment for me to visit until he returns from his holiday after Easter. He does not answer his phone. This is a little frustrating for me as I need to know now to book flights/plan my schedule to coordinate with a visit/wedding in the UK.
So I thought I may as well give him 3 months notice, but that means he moves out on July 31, which is kind of mean of me, but since he won't answer my emails and calls maybe that's what I will have to do!
July 31st is also when my daughter needs to find a job to support herself. Living in the Bay Area, striving to be a music producer, while.working P/T is not easy, she is quadralingual, double degree, accountancy, housing management, governmental office management experience, so would probably make more money in CH.

Does your rental contract with him actually allow notification for end of July? I ask because many rental contracts are tied to specific cantonal moving dates: 31st March, 30th June and 30th September. If so, then you'd have to give him notice for end of September instead as you've missed the June notification deadline.

There's an apartment a few doors down from ours on Comparis, with a tenancy end date of 31st December, so yes.

I was wondering about this, I think not because we are on a month to month contract.
I will not relet, too much hassle for no profit when living in the US. Tenants that are getting really low rent and insist on having the latest appliances like a steam oven.
If my daughter moved and needs to make money she can let rooms out if she wants; it's a small 1996 upgraded 4 bedroom. So easy for her to let while studying in St Gallen or working in Zurich.

Official moving dates here are April 1st, July 1st, October 1st. Although they're still the most popular moving dates, most landlords no longer insist on those.

1st of August is no problem to move. Up until a short while ago, we all worked on August 1st

Not for Zürich, both city and the rest of the Kanton only have March 31 and September 30, of course subject to the contract specifying differently. For an online check see here.

What's more, the current renter can ask for an extension. Since he's been renting the Apartment for 8 years his chances are probably quite good to get one.

Same for us here in Fribourg, our rental contract specified only March 31st and September 30th. Each canton is different and of course not all contracts use these dates either - which is why everyone needs to check their individual contracts for the info. Also need to check the notice period on your contracts, the norm is 3 months but ours was 6 months so our rental agency had to give us notice by the end of March for us to move out by end of September.

Hoppy if your rental contract is month by month then it sounds as if you'd be okay to give notice to vacate by 31st July.

Yes, I think I read that I have to allow him and his family time to find a property of similar standard, for similar rent. That means he had to find a modern 4-bedroomed house, with garden, sheds, 3 park places, one covered for about CHF1600, 30-40 minutes from Zurich by train and about 30 minutes by autobahn, 5 minutes walk from shops and schools in an idyllic village.
That won't be easy. Plus, I think he is nearing retirement age.
So I'm guessing it will take 6 months? There is no special leaving date stipulated in our contract, the contract expired so he is now on month-to-month. We contacted HEV they said that 3 months is fair. Unfortunately, I cannot pay fir an HEV membership from the US. I asked to have the bill mailed to my Swiss address and asked him to forward it to us, but w never got it.

He threatened us with the rent tribunal before, but found out that he was paying on or below fair rent.

I think we should give him notice now. My husband is reluctant.
At present the tenant is refusing to give me an answer as to where he can confirm my visit time; he says he is on holiday and cannot confirm until after the Easter holidays. He has refused to leave a key with anyone else for the appointed time.

We respond immediately for anything he wants, wherever we happen to be, new appliances, small repairs etc.

I could not wait longer to book my flight to the UK for a family wedding, so I booked it with a few days extra, during which I will camp out alone in an airport motel, waiting to see if he will allow me access to assess and photograph the condition of our property.

Anyone with suggestions please chip in!

If the contract does not explicitly say that it is cancelable to the end of any month than the usual local moving dates apply by law. Art. 266c Code of Obligations https://www.admin.ch/opc/en/classifi...dex.html#a266c

Also read about all formalities which must be met to cancel a contract or it will be null and void.

It is likely that the rent may be extended a full 12 month. This can be reduced when you intend to live there for your own.

Send a registered letter where you propose three dates in August. He can pick one. Done.

Excellent! Thank you so much for your replies. The tenants' lease was for one year, which started 7.5 years ago. We need it for my daughter, or even for us if hubby retires early.

There are people , who are working on Aug 01 st, like employees at a hotel,
Airport, Public Transport, Shopping Centers (Airport/Train Stations), Fire Fighters, Hospitals, Museums, Zoos, .........
The list goes on and on ........

Yep. But as ASwiss pointed out - a long time ago (me having a memory like an elephant does put events closer together it seems )

I'm not surprised though that you picked one of only 5 cantons that didn't have people working on August 1st when you arrived
