How long does it take to get rental deposit back after moving out?

It's been 5 months since I moved out of my old flat but I haven't received my deposit back. I asked the realtor agent and she said it will take some time for the process. How long does it usually take? What's your experience?

It varies a lot but legally they have up to a year to give you your deposit back.

Oh, szdro, thank you for the tone in this post of yours! You make no accusations against the landlord or the agent, but instead are simply and politely asking for the information you need about the way things work. I like that.

The deposit refund can take a while because it is partly to do with the heating bill. Each year, after the end of the heating season, the agent makes a calculation based on the full heating bill, to apportion the amount to each tenant. This is according to some key, for example, the number of square metres of each flat.

The "end of the season" is a variable date, since it depends on how cold or how mild and how long the particular winter was. Also, the oil price is a variable but relevant factor.

Rather than billing the tenants only in winter, the tenants' burden is distributed in twelve even monthly payments, but this amount is merely an estimate of the anticipated heating costs. This means that, after the big calculation has been done, sometimes the tenants get a part of the heating costs refunded, and sometimes they have to pay in more.

In addition to that, the landlord has to account for the fact that some tenants move in or out before, during or just after the heating season.

So if not mentioned in the contract, they can give you back after one year with out reason? Any legal way to claim it back or part of it earlier?

I have an issue with my rental deposit and the agency does not respond to my e-mails and does not answer on the phone.

I had my handover about 1.5 month ago. They were inspecting the house for approximately 1.5 hour. They found out 2 issues, one which was clearly my fault (but something extremely minor) and also they claimed that there was humidity in the silicon around the bathtub. I agreed about this and they made a note that I will pay for 100% of that (which seems ok for me to pay for 100% of the remaining value of such a thing).

It took them about 3 weeks to arrange fixing that and then another 10 days or so for them to get the bill from the company that replaced the silicon. After that, they send me the bill, they charge me the full amount for the silicon replacement.

I checked on the Tenants association website, where it was indicated that this item has an estimated lifetime of about 8 years, so I am only liable for the remaining value of this. I contacted my private liability insurance company and they told me that I should not be paying for this, as this is normal wear and tear (they also refused to pay this as it should not have been charged to me in the first place).

As a sign of good will, I sent an e-mail to the agency, asking them to reduce the price so that I pay only the percentage that corresponds to the time left (even though it was clear to me that I should not be paying for this). I have been trying to contact them so many times, there are no replies to my messages. I try to call them, there is always the receptionist picking-up and he always says that I cannot speak with the agent, she will write back to me. Another excuse is that she needs to talk to her boss and then she will write back to me. The latest excuse is that she is out of office for 2 days and then when I said that I want to speak to her boss, the boss also turns out to be out of office for the next 2 days.

It seems to me that they are avoiding me. The problem is that a relatively big deposit is tied up with them, the paper they sent me to sign is basically a consent that they will release my deposit but reduce it by the amount in the final bill.

So what are my options? I will try again on Monday (when the agent will come back), if this also fails, I will send a registered letter, indicating that I need an official reply by them. What can I do if this fails as well? I also have legal insurance, I can also get them involved.

For me it is not so much of an issue of money, the amount they claim I have to pay is less than CHF 300, and the deposit is more than CHF 5'000. But it is a matter of principle. I wanted to discuss with them so that they can explain their side of the story and either accept or reject (with a valid explanation) my counterproposal for a reduced bill. But they are avoiding my calls and my e-mails. I am not aggressive or impolite (at least in the beginning), but now it is clear to me that they do not want to speak to me.

I wouldn't rely on emails. Send registered letters instead. Costs CHF 5.- on top of the postage but is well worth it.

EDIT: just saw you mention this at the end of your post but perhaps you should have sent the earlier correspondence via registered, too?

This is what I intend to do next week, after one more attempt to call them. But I am afraid that they are going to ignore my registered letter as well.

That probably makes it a very clear case, assuming they used something like "100% der Kosten" instead of "100% des Zeitwerts". Chalk it up to experience and think twice next time you're about to sign something.

Plus, by having them fix it rather than doing it yourself you're at their mercy as to whom they engage, and thereby to some degree what the repair costs.

They used 100%, nothing else. But ok, there are many ways to interpret this.
And this cannot be a justification for avoiding my calls and ignoring my e-mails, by the way...
I understand that they can do whatever they want, unless you send them a registered letter (I am pretty sure they can ignore it too), but there is a difference between having a dispute about the costs that I have to pay and flat-out refusing to talk to me about it for one week.

Quick question here...

I sent to the rental agency a registered letter last week (in English, would this be a problem?), accepting their charges (rental deposit form signed by me but it was not signed by them) and demanding a reply within 2 weeks with proof that they have sent the signed form to the bank to release my deposit, since there are no other claims from their side.

Till now, I have not received any reply from them by post. I have also not received any reply to the numerous e-mails I had sent before my registered letter to the agent and her superior. They have not called me back, even though I left so many messages at the reception (they refused to allow me to speak to the agent).

I will not try to get in contact with them till the end of next week, but I suspect that they are not going to reply to my registered letter. What are my options after that? I have legal insurance, can I activate it? Or do I have to wait for one year to pass by? Handover of the flat was mid-February.
