Landlord wants me to pay, i think should be him.

Hi everyone!
I submited a question before that was answered really well so i will try with this other one that is giving me some headaches.

In my rented apartment I hired some internet provider, but there was a problem with the building cable and an electrician came to fix it. It was something in the box that has all the connnections of the building.( not exactly a building, but an old house with 3-4 wohnungen)

I understand that if i want internet connection I have to pay for it. But if there is a problem with the cable that gets to the street, that is outside my house, wouldn't it be the landlord who has to pay for this? I rented a house with no proper cabling outside it and now i'm told to pay for the electrician bill.

Could you help me on this to know what should be done?

Thank you very much.

What does your rental agreement state concerning Cablecom / internet connections to be provided?

It is a good thing to be a member of the Mieterverband, 100.- yearly but they are great. Lots of info for free online - see above!

Re: Landlord wants me to pay, i think should be him.

Is this also the telephone landline connection cable? Surely the house should have a correct workable cable? If it doesn't, the LL should provide one.

I thought it would be up the the provider and the LL between them to ensure the house is connected to the main street cable and make the necessary repairs if lines are faulty outside of the house.

If you had no electricity in your apartment because the main line connecter from street to the house was faulty, it is not up to you/ the tenant to pay for it?

You didn't follow the procedure prescribed by law: inform the landlord about the defect and give him time to react, Only after that you could pass the cost to him (Art 259b OR). I think you're going to have to pay this one

Did you give the landlord a chance to fix the cable, or did you just order the electrician yourself without consulting the landlord?

If the last is what happened than the bills is yours.

I'm here again.

Yes, i told the landlord to fix it. He told me that he called the electrician. The electrician came, fixed it and then i received a receipt at my name saying i had to pay for it.

I was waiting for 2 weeks with paid internet but not conection waiting for the landlord to do something.

In that case, call cablecom and tell them to bill landlord - he ordered the electrician, he's paying

Re: Landlord wants me to pay, i think should be him.

It depends what had to be done.
Is this Internet through a TV provider such as Cablecom, or is it DSL Internet through the telephone land line (Swisscom, Sunrise, Green etc), or is it Fiber to the Home?

If it is a telephone land line sometime the correct line from the street has to be hooked up with the correct line in the house. In that case I would say the cost as to be payed by the tenant. As it is not a fault in the installation per se.

Not sure you are correct there. The landlord appeared to order electrician on behalf of someone else. Does that automatically mean the the landlord has to pay?

I think not.

Re: Landlord wants me to pay, i think should be him.

From where do other tenants get their internet? Surely if this is a general problem, others will have similar issues.

I can't see how you should pay IF this was really a standard provider and it doesn't say in your contract that you can get your internet connection from only one specific provider (and that one is different than the one you chose).

Good point but I will take it the other way.

If no one has complained then why not check this out first. If no other neighbors have same problem then it is probably a bill for the OP.

I am thinking, why should others pay for a line they may not be using.

See my point?

However this does not rule out the owner from paying too.

Investigate.

Re: Landlord wants me to pay, i think should be him.

Are you sure that it was a fault?

I don't know if it's still the case, but it was certainly common to have to employ an electrician to set up the telephone line between the apartment and the main connection box for the building (often in the cellar), especially if the previous tenant didn't have a landline, or you didn't know their number.

The cost was always borne by the tenant, and a nice little earner for the local sparkies (and their apprentice - I once got charged an extra 50% because the electrician brought along his PFY to gawp).

As aSwissInTheUS mentioned, this could well be the case if your ISP is Swisscom, Sunrise, or another supplier that uses the telephone line to complete the connection to your apartment.
