Moving out of apartment before contract ends

Hi All,


We have a binding contract for two years until 2019, but we want to move out to a bigger and newer place before that. Therefore we need to find new tenants for our apartment.


What is the most appropriate action in your experience:


- Find something new for ourselves first. Let's say sign a new contract starting in few months and look for tenants in the meantime. If we give ourselves enough time hopefully we should be able to find someone in a few month period. Perhaps we have to pay two rents for a month until we move all the furniture, etc, but it seems doable.


- Find tenants first and then look for a new apartment. Problem here is that if we cannot find a suitable place before the new tenants arrive, we are stuck with a bunch of furniture and nowhere to go.


Also, when do we inform the current landlord that we will start looking for new tenants to take over? After we have signed the new contract or before we start searching?

It also depends a bit on your location, our previous apartment was modern, fairly priced and freshly build on the Seestrasse in Wollishofen/Zürich, so finding people who would take over on short terms was a piece of cake, and they indeed were lining up.

A few months for an apartment in Zürich should normally be more than enough time to find somebody, So I would just go to search a new apartment, sign that contract and then find a nachmieter to take over your existing contract, once you have found this person you go to your landlord.

What about the application form which is being completed by the nachmieter and sent to the landlord? Should that application form come from the landlord, meaning that they are aware for move?

You will want to know if the applicants (three are recommended though in theory one should be enough) are solvent, i.e. rent less than 1/3 their income. Because even if the landlord refuses them you're still out of the contract. To make a copy of their appliction you need to have it in your hands for a bit.

When I was applying for apartments, I remember there was always application form in the apartments I visited. Who provides the form then if the landlord is not involved? Besides shouldn't the landlord be approving the new applicants? I am sure are not looking only at the income as stated on paper, but also call the employers, check for permit, etc.

Find new place first, then cancel your appt by registered letter to landlord and tell them you will be looking for a replacement tenant. You can ask your landlord for application forms for the new tenants or find them on the site of the Mieterverband, where you can also find example letters and more info on the correct procedure: https://www.mieterverband.ch/mv/miet...er-auszug.html

I believe if you find someone similar to you in income and risk factor your tenant must accept, but he can deny anyone is not "like" you. So might be worth to check with your tenant what they are looking for or just forward all the applications to them.
