Handover apartment in Lausanne -- Terrible experience

Hi,

I recently moved from Lausanne to Zurich and had the etat des lieux with my previous place. The lady from the agency found minor issues and made a bill of 680 franks (clearly a scam).

150 Fr of this includes complimentary cleaning which was added as a temporary expense if the professional cleaning company with handover guarantee (that I hired) didn't come back to clean properly. However, today (around 3 weeks after etat des lieux) I got a mail that the 150 Fr will still be charged because the cleaning company didn't do their job properly.

They are clearly scam artists. And now after checking their reviews online, I see that this is business as usual for them. In fact, I am sure that they didn't call extra cleaning because they had someone else moving in literally the next day (and the apartment was really clean anyway).

My question is:

1) Can I do something about it? I have already moved to Zurich so going back to Lausanne for paper work is not a good idea.

2) Will my household insurance cover it?

3) For future references, what could I have done to avoid such scam artists.

Get a membership at ASLOCA/Mieterverband.

Costs you about 100.- per annum. You can call them to the handover and they will interfere.

Ask your cleaning company to reimburse you for the 150 Fr.

Demand to see the bills, and contact your cleaning company about this, because it makes them look bad.

1) If you had a handover guarantee then why did you not contact the cleaning company again to discuss this with them? And did you ask for a receipt from the rental agency to prove they had done the additional work? Also I guess they have a checklist that shows what exactly was wrong?

2) How should we know? Use some initiative and call them.

3) Challenge and ask for evidence of everything.

Can I ask which rental agency was this? Even a private message is fine. Just so I know if I should mentally prepare myself for this when I will eventually do a handover.

The problem is that I live in Zurich now. For me, this apartment move coincided with a job change, a canton change and a lot of other family issues. That's why I didn't have enough time to be proactive. I will keep it in mind.

Two questions:

1) Will the Zurich version of As loca be able to help me here?
2) I have asked them for bills but they haven't replied them yet. The insurance company is also asking for bills. What can I do here?

Can I mention their name publicly here? Are there any consequences to that.

I would love to do that, as it is clear that scamming is their MO.

The 680,- is very likely gone, you agreed to pay this for the things they found, and you by signing acknowledged indeed were existing. (Why did you even sign if you thought it was a scam?)

As for the 150,- it depends how all is exactly written down.

As for Asloca and such, they are likely to not take up cases that existed before you became a member.

I argued for a very long time. But, they kept coming up with random reasons.

I had to move in a few hours as my next apartment was ready in Zurich, so I couldn't stay there for longer.

My main concern is about 150 Fr for cleaning. They mentioned that it is temporary and will not be charged if the professional cleaning company comes back and cleans some stuff. The company came back and cleaned (although I don't know how they did as I had already left).

however, last week I got a mail saying that the cleaning was not enough and we will charge you 150 Fr anyway. I am 100% sure it's a scam.

I have asked them for the receipt for the cleaning, but they haven't replied in last 5 days even after sending 5 e-mails.

I don't care about 150 Fr (tbh). At this point, I am really pissed and don't want them to get away with this. Can I ask as-loca to do something now?

Don't they have to give me receipts? They can't charge such things randomly.

Be proactive and cautious, to avoid feeding and empowering those scam artists.

In your case, fight any unjustified bill(s), and share openly what happened.
Report the alleged offender to FRC and the likes.

As for future occurences, as others have said, challenge and ask for evidence.
Know the law and your rights.
Learn how to do a proper handover and contest any unfair bill(s).

For example, in the final written handover inspection there should be some comments regarding the entire state. Have you signed and kept a copy showing it's good? If not, you have to ask yourself why.


PS: even that they can cheat, mine added some infos after I signed, a classic trick. Well the guy tried, at least, to steal me over 600chf in a legitimate way (signed he modified the already signed documents). No need to say they got full retaliation and I made them sign a document and I did not pay anything (they had no choices but to accept or face numerous legal problems).
