Tenancy Laws Confirmation??

Hi all!

I'm trying to arrange a potential tenant for a lease takeover for my apartment to start pretty much immediately (my departure date is non-negotiable unfortunately). Due to various matters, I need to leave and I need to leave very soon. I am looking to see if anyone has a website or anything that explicitly states the tenancy laws.

The rental agency is not really giving me information in a complete manner. First they say I can find a new tenant but give no further explanation, then I get yelled at because I found an interested applicant and wanted to clarify what I need to do, then the agency says the tenant must apply but does not give me an application to pass on, etc. So I've started going about things how I've been told thus far: I submitted my letter introducing the tenant saying that my move-out date is firm (with a handwritten note from the applicant from the day of their visit expressing interest in taking the apartment right away), directed them to the online application, and told them they'd need to submit a Betreibungsauszug. Which is what I can do at this point with a somewhat-snippy office secretary

On to the point of my post. I have found only parts of the tenancy law online, specifically the points that state that I can cancel my apartment contract outside of the specified period if I provide them with a legitimate candidate for tenancy. I only need to provide one applicant to the landlord, who then has max 30 days to approve or reject.

However, I've seen in other threads on here and in articles that, should the landlord reject this applicant, responsibility for the apartment is lifted from me since I acted under the proper condition. Can anyone confirm if this is true or not? I live in the canton of Luzern if that helps.

Be aware the the English translation is non-official. If in doubt change the /en/ in the URL to /de/, /fr/, /it/ to get an official version in one of the Swiss languages.

Early return is handled in Art. 264 https://www.admin.ch/opc/en/classifi...ndex.html#a264

I am not aware the Lucerne has extra regulations, apart does stated in the Code of Obligation.

The term you're looking for in German is nachmieter.
