terminating the renting contract

If I send tomorrow the letter with termination of my renting contract, do I state the last day in the appartement 28th of Sept or 1st od Oct? 29th and 30th of Sept are weekend.

I´d say you cancel by September 30th. Will it be picked up on Saturday? Otherwise it is too late

Indeed, must be received by Saturday, not sent!

Or do the collect and read their mail on Saturdays?

(most businesses don't)

So, Saturday-7 to be sure.

I need to have 3 months termination time. my plan is to go in new appartement at the begining of September. So if someone new comes sooner, great.

I just want to know what should I write by the law.

I think what they are trying to say is that your notice must be received by the last business day of the month not just sent. If your landlord doesn't pick up the mail on Saturday then you're out of luck for giving notice in June. You'd be giving 3 months notice at end of July (meaning you're only out of the lease end of October).

Put 30th Sept in the letter and if you can, deliver in person on Friday.

But if I send it tomorrow and with eingeschrieben, than it will be delivered on saturday. because A post is delivered on saturday. right?

and if in contract it says that the termination information should come either in hands of building management company or "bei der post abholbereit", then that should be ok. right?

Only if someone is in the office to receive it.

Certainly there is nobody at my work on a Saturday to do so.

Almost all postal offices do close on twelve, pieces that cannot be delivered are only going to the postal office after the route in the neighbourhood. Changes are very very high that the note will say that the letter can be picked up as of Monday and depending on your contract you might be in for another year, but at least a whole month.

You're walking a very thin line, just go by them on Friday yourself, give them the letter and ask for a signature that they received it.

Registered letters have to be signed for. If no one's in the office on Saturday there's no one to sign for it. It would go back to the post office for delivery on Monday and the post person will leave a card stating they have a letter to pick up at the post office.

As suggested if you want to make sure deliver it by hand tomorrow yourself.

And check your contract to make sure termination dates aren't tied to specific dates of the year. When we rented we had a 6 month notification period because we could only move out on 31st March or 30th September.

I've yet to hear of such a contract in Bern. Maybe they exist, but I've not known anyone that had one. Standard 3 months is the norm, except you can't move out 31 Dec.

Ok.
So if I don’t make it tomorrow to go to there office, if I terminte and can exit not before end of October, the cleaning company can return the app, I don’t need to be there? That’s the possibility, right?

We do not know your contract, so we do not know your next possible cancellation date, maybe next summer is your first other option. If not is stated that you can cancel per any month, and it does not state September or another month than the 31st of October is your first option.

And you can give them the keys earlier, as long as they sign the handover form and you keep on paying nobody minds.

We had a contract with 6 months notice, and only June 30 as the leave date.

We handed over the keys this evening.

We had gotten into the habit over the past 5 or 6 years of handing in notice in December of each year (just in case), and then cancelling it some months later.

You don't have to be there for the handover, although it's a good idea to either be there yourself or have a friend there - so that you're sure the landlord isn't charging you for damage you didn't do. And yes, get a cleaner that has a handover guarantee. That means they will re-clean anything that's not up to the landlord's standards.

Can you maybe go to work a bit late tomorrow and drop off your letter on the way in?

"auf den nächsten vertraglichen Kündigungstermn", the next contractual cancel date. Assuming that's what you want.
