Apartment water damage costs

Recently there has been significant water damage in our block due to construction workers who were replacing the water pipes in the building. Due to this water damage we were informed that the building was closed off by the police. There has been no water or electricity for 5 days.

Luckily enough our unit has seen little to no damage. Since it was uninhabitable for 5 days however I have incurred some serious hotel bills.

The landlord's rental agency claims that they will not pay for these incurred costs. Do I have any leg to stand on to get this back? They specified in an email that we should book a hotel and send them the bills for their insurance.

I would say that the builders' liability insurance would be the one to pay - for any direct water damages.

For your apartment not being habitable, here the rental agency is liable. The rental agency should them claim it with the construction company.

bublous, you may want to update your location.

Of course they're liable for replacement accomodation. Unless you booked some luxury hotel I don't see why they shouldn't be liable for the full amount. They're also liable for the additional cost of your meals, I'm sure there are some default values available. The calculation is something like "actual cost less what eating in your apartment would have cost".

Your contract partner is the owner, and the ageny in their stead. I wouldn't send the bill to anybody else.

And the standard advice: Get advice from the Mieterverein/ASLOCA.
