Contract termination because of "hidden defects"?

Hi all,
Just moved here, and successfully rented an apartment. After moving in I found out there is a very loud heating machine that is causing one room to sound like being in a train!

Are there some certain laws or special forms where I could immediately cancel the contract based on "Versteckte mangel"?

Probably not but ask your landlord first to do something about that.

Yes. Its probably the heating pump if its an old apartment. Have you spoken with the agent/owner.

What is amazing, is that people feel you can walk in and out of contracts with no further ado.


How would you feel if the landlord suddenly did the same to you ? "Tomorrow you can piss off because i don't like the colour of your car"


Speak to the landlord, explain the problem, obviously as it is so loud can could make a recording on your phone, no specilaist equipment required, say it needs fixing and if this fails join ASLOCA (Renters association) and get them involved.

Thank you all for your replies, appreciate it.

Yes, I spoke with the owner, several times actually. He is aware of the problem, and even has ideas how to fix it, but he says he has to invest money in renovating another apartment in the building to rent out, before investing to fix the noise problem.

There are no laws involving these hidden defects?

Thank you for the advice to join the Renters association, this would be the "Mieter Verband" in German?

Yes you do have a right to have your rent reduced if the noise is more than a certain limit
