Withdraw apartment application

It's about the admin fees on rental application forms like this:

Wenn Sie Ihre Anmeldung nach der definitiven Vertragsausfertigung zuruckziehen, verpflichten Sie sich zur Zahlung einer Umtriebsentschadigung in der Hohe von CHF 100.00 zuzuglich MWST.

I don't speak German but I suppose they are all different variants of similar things. (In this case I can't even find a definition for Vertragsausfertigung.)

I have seen different interpretations of what happens when you withdraw:
1. You pay the fee as soon as your are accepted and before even receiving the contract.
2. You pay the fee after your are accepted, receive the contract but before signing the contract.

I read many many threads there about such clauses, can anyone give a definitive answer of what this means?

Option 2 in this case.

However these clauses are considered not legal by many

I suppose there is a difference of what they (1) could do legally, and (2) would do in practice. Do the landlords/agencies actually send the bills in case 1 or it's just bluffing?

Oh don't worry. They will send the bill and you can tell them it is illegal and throw it away.

What happens when I apply for multiple apartments from the same agency? If I don't pay the fee to withdraw one would they simply refuse my other applications?

They will deem you a complete waste of time & they won't bother with your application.

You should be transparent about this and make clear to them what is your priority etc. But indeed if what you do is multiple applications and leave them hanging they will move onto next potential tenant as you will not be considered reliable.

What is your exact question?

If it is if the contract is valid: Yes, and after signing you can be held to all terms as for cancellation periods and such (and pay up offc).

Your location says Zürich, if so normally there should be high demand, best to talk to the agency and find a deal that works for both.

It's not relevant whether you have moved in or not, once you have signed the contract you are bound by the terms, just the same as any other time. So the standard rules and penalties apply regardless.

Now what is your actual question?
