Can I rent out my parking spot?
 
The apt came with a parking that I don't use, can I rent it out to people who don't live in the building? Will I get into trouble?

If you are a tenant, then you have to get the landlord/agent's written permission to sublet. As long as you produce the proper documentation, that is: proposed rental contract with your tenant reflecting their full name and address and showing that the rental is reasonable (so as not to unfairly enrich yourself at your landlord's expense), permission will almost always be granted.

The simplest way to do this is to ask your neighbours (with the same landlord) and see if there's anyone looking for a space, and then you and they approach the common landlord together.

Just had a slightly different question but on the same topic. can someone rents a parking spot from their owners in a building can rent the parking place to someone else during the day?


for people who drive to work everyday, their parking place is empty during the day and can be used by someone else who works nearby thus avoiding high parking costs on the street. Is this even allowed legally? I have not heard of a rental contract that allows renting out parking place by the tenants.

The challenge is how to give the renter access to the building/parking. I donít think the landlord would like you giving keys/cards to someone not known to them.

According Art.262 Swiss Code of Obligations https://www.admin.ch/opc/en/classifi...ndex.html#a262 an sublet must be granted in case of the following conditions

1 A tenant may sub-let all or part of the property with the landlordís consent.

2 The landlord may refuse his consent only if:

a. the tenant refuses to inform him of the terms of the sub-lease;
b. the terms and conditions of the sub-lease are unfair in comparison with those of the principal lease;
c. the sub-letting gives rise to major disadvantages for the landlord.

3 The tenant is liable to the landlord for ensuring that the sub-tenant uses the property only in the manner permitted to the tenant himself. To this end the landlord may issue reminders directly to the sub-tenant.
The highlighted part might be used to deny the proposed sublet. Landlord and specially people living nearby might want to have as less vehicle movements per day as possible.

That assumes that the space is in a parking garage and not outside, as ours are.

Hi,

Is the parking exclusive to people living in the building? On the places I've lived, landlords rent available parking lots to neighbors, restaurant guests, etc.

Where I live right now the underground parking is shared with employees from a Migros and guests from a hotel. If this is the case, the arguments about "less traffic" or "disadvantages to the landlord" make no sense at all.

Hi Op,

I just did this - rented out our parking space - as we thought we were going to buy a car when we first signed the lease but we never did so.

First, as others have suggested, you need your Landlord's consent. I met with my Landlord and suggested we work together. I thought I could get her a better rental rate for the spot and I would be in charge of advertising (and she would help with the German Translation) but I wanted her to bear the responsibility/onus of the lease if we did rent the spot. No way would I want that liability.

I ended up paying for a listing on Comparis and we found someone interested in the spot within a few days. Now, my Landlord makes 50% more for the space than she did with us and we pay less. It worked for both of us :)
