Permission for replacing car port and pergola
 
Sorry if this has been asked before. Do you need planning permission or approval to replace an existing car port and garden pergola? (In Geneva)

Depends on the commune but I suspect you will likely need to submit proposal for approval

Do you know if the existing structures were permitted?

- I have run into properties where an unpermitted structure was tolerated/grandfathered, but any replacement would not be allowed, or would require going through the permit process again. So check existing permits (or lack thereof) before you go much further.

Are you changing dimensions or changing any other aspect of the structures in any way?

Is the pergola built as a permanent structure?

Yes, I believe they're permanent structures as they appear on the commune plans. Good points tho - I'll give the Mairie a call as I guess the answer is quite nuanced!

We faced this with our place. Ancient DIY tool storage (calling it a shed would be way too ambitious) and a rotten pergola. We told the Gemeinde they would be replaced only to find out that they had never been approved. Fortunately no problems to get the new ones approved, as it was clear that the old ones were long standing.

We also assumed that because other neighbours in the block had conservatories on part of their terraces, we would be able to do so too. All approved by the association of owners only to be told that the planning laws had changed and the roof of the conservatory would be too far off the ground (we have the top floor of a Terrassenwohnung build into a hill side) per current regulations. It's complete nonsense, but nothing we can do. It was also a strong driver in buying the property. Lesson learned - never assume anything with Swiss property. The project manager isn't super local, so he was caught out by it too.
