Neighbour's marijuana smoke sipping into our apartment

We moved into a small town in the canton of Zurich. The town is amazing, close to work, lots of families with kids.

The problem we have is a neighbour who smokes enough marijuana to make pollute our terrace. Now we can't even enjoy our terrace or leave windows open because the marijuana smoke sips in, making the apartment unbearable.

I asked the neighbour to be considerate. His response, more or less, was f.u., you can't do sh*t, marijuana is legal. This took me back, since I was asking him to be considerate, since we can't leave our apartment during the covid lockdown. We now feel like prisoners.

I realized that instead or escalating the issue with the neighbour, I should instead make it by building managements' problem.

I have emailed the building management company over the past month and a half regarding the offensive smell sipping into our apartment because the neighbour is smoking.

What steps should I take to escalate the issue?

That's awful. Generally, neighbors tend to be very considerate. If the building mgt doesn't do anything, you may approach the municipality. Marijuana is legal and so is smoking in "your" apartment, as long as it not a nuisance for others.

Cannabis is not legal in Switzerland. With that in mind it may be explicitly or implicitly prohibited as part of his lease. Maybe even smoking in general on the balcony is? Check your lease basically - hopefully building management can sort it out.

Marijuana sipping is becoming the " in thing"!

Some leases stipulate no smoking so I would start by checking the terms. I wasn't sure if it was legal or not so here is the result of a quick search

I seriously doubt your neighbours are consuming legal (less than 1% THC) pot.

Why would they do that if they are not getting high. If it was for medical reasons they would have said so. And if it is just for the CBD there are other ways to consume it that do not involve burning.

Talk to other neighbours, if others are bothered as well it could help.

Join the local renters association. They can certainly help, they know the laws and the proprietorís responsibilities.

CBD is legal (weed without the THC that gets you high). It’s almost impossible to tell the difference without a test. Weed with THC isn’t legal. But if you have a small amount, the worst that could happen is a ticket/small fine. Both are smoked widely throughout Switzerland.

If the landlord and the tenant are unwilling to help, then I’m afraid there is nothing that can be done besides moving homes. Try calling or visiting them in person next time. Good luck!

Send your complaint to the management via registered mail. E-mails are often easy to ignore, registered mail carries a different weight.

But you do need to be realistic in your expectations of what management intervention might achieve.

I'm afraid it may well come down to this.

When a neighbour's behaviour makes living in your flat unbearable, I'm afraid that all too often the only practical remedy is to move.


Hope a resolution can be found - or failing that, a new flat.

So if it was cigarette smoke everything would be just fine. No problem??!!


Move to a ground floor appartment or close your windows. Anything else is a full waste of time. Or learn to communicate your concern to your neighbour!

Not for me. Iíd take weed smell over tobacco any day. But in general, the Swiss are the absolute worst when it comes to respecting others aversion to cigarettes. Now that there are rules at the train stations, they usually respect them there...but otherwise, they will stand within an inch of you at a bus stop and blow it directly into your face.

I dislike both smells. I wouldn't even try to enter a discussion about which is worse. I don't have a problem with people doing their own thing in their own time in their own home, or even smoking in my presence if they do so respectfully. But if the smell is annoying others, and they don't see what's wrong with that, they've crossed a line.

We also have someone smoking in the building next to ours. Once she starts smoking the living room stinks within a minute, I have to close the window immediately... And regardless of how fast you close the window it takes much longer to get rid of the smell (and of the poison even if not in a big concentration). So I do understand how annoying and disturbing the situation can be...

People who smoke pot outside should go live next to a pigsty. In my nose, the smells are comparable.

Threaten to call the cops on him (since it's illegal to smoke it here or have large amounts of it in your possession). Or just do call the cops. Sometimes the cops can be really helpful in "annoying neighbor" situations. I had to call them once when some teenagers were partying in a storage/hobby room, right below my little boy's bedroom, which made him unable to fall asleep. The cops were here within five minutes and were so nice and helpful.
I know it sucks to call the cops on someone, but since your neighbor had told you "F U" it sounds like he might deserve it.
