Renting nightmare
 
I moved in with someone, it did not work out, they asked me to move out and they would cover my cost of the rent. (I have it in messages but not in writing)

I moved out and I thought that was that ...

The other person then moved out two weeks later (like what an earth but anyway) and now has given notice to leave the country to the Regie

The agent who was really good, told me the other person is still liable for 50% of the rent, even if they leave the country.

As the other place is quite expensive no replacement tenants found so far so :(

We both wrote and gave notice ...

Possible option+

Find a replacement tenant for where I moved to, it is a great place!

Move back & pay my half and wait until we found replacement tenants?

At worst case scenario, could you sublet at a lower price and cover the difference.

That is an option, there was an offer at 600 CHF below the rent but the other person rejected it.

Join the tenants association now if you are not already a member.

They should give you good advice and are well worth the joining fee for now and in the future

I am in a much better place than I was a few years ago & I can deal with this much better.

It's life and I was absent minded and my mistake, I own that ... (love does strange things to a person, even if wants to exit in a nice way)

It's not what happens it is what you do about it, just appreciate a bit of advice, even if I think I know most of the answers.

As they say I am paying for an education...

That's true, but you're still liable for the full amount. Unless the regie is unaware of this (highly unlikely) they'll probably come after you for the full amount if your ex doesn't pay their share.

Since you've both given notice the old contract will end. However a follow-on renter will want the contract to continue, otherwise they'd risk having to move out after a few months, upon the end of your contract. You probably want explicit confirmation of the regie that they'll accept the new renter with unchanged conditions into a new open-end contract that starts when the follow-on renters move in.

The paying half the rent will not work in the long run. Urs Max mentioned it - if shit hits the fan you will be liable for the entire rent (and you can go after the other persone for it but that will be futile, I suspect, as your chances are even smaller than the regis'.
So, if you want to enjoy the great place while you pay rent for it (possibly even the entire rent) - yeah, why not.
But if the resignation time is only three months you'll have a hard time finding a tenant for the other flat in time to be worth the hassle.

Being a lazy person when it comes to moving, I would simply get comfi at the new place. I'd try to find a tenant for the old place for half the rent (that brings in your ex-flatmate's rent in case you have to pay it).

Now, this depends a lot on who signed the rental agreement.


Was it signed jointly or by you alone ?



You need to think past whatever 'worst case' period there is - which flat do you want ?



Sounds like you want to stay where you are, and let the other place go. Either you pay the notice period and let it go with the landlord to find someone new, or you try to find a 'nachmieter' sooner - someone to take it over.


Oh, and make sure the ex- has handed the keys back - has the landlord done the inspection ? The biggest risk is leaving it empty and having someone trash the place when you are not there...



If you don't want the old place, then you need to do the handover ASAP and have confirmed in writing the notice period and how much rent total will be due. In writing from the landlord. Was the deposit paid jointly ? Did you get household insurance ? Did you register your change of address at the Gemeinde ? Is your ex- likely to a) refuse to pay b) trash the place c) fail to return the keys d) walk out without doing the handover ?

Great advice, time for brain cells to calm down a bit.

Going to work hard on getting a replacement tenant & stay where I moved too.
