Compensating Construction Delays during Covid-19

Our house completion has been delayed by 2 months, so legally they are obliged to pay for the delay resulting in I.e hotel expenses or two months’ rent with current landlord, but does anything change during the Covid-19 considering the government did not instruct stopping construction work.

The company could defend using force majeure, but how would they justify this when there were no restrictions on building works, and are they insured for such eventualities?

If the work/situation does not allow dealing properly with the legal restrictions then it is out of their hands and thus force majeure.

And no they are not insured, either it is not their fault and your problem, or it is their fault and no insurance will pay if there was no legal reason to delay the work.

Just have a talk with the company and see what they have to say, based on that you could choose to take further steps or just accept the situation.

We started a massive renovation last September and will be finished in 2 weeks. We live in Aargau which didn’t stop building sites from continuing (Covid 19) but several areas did. If the delay is due to this then it is out of their hands and can’t be held responsible, if not check your contract as we had a section in ours that covered financial responsibility in the case of a delay.
