a question on Kündigungstermin
 
Hello All
I have to move out and i found a form in German to send the Kundigung. However, since it is my first time since i am here when i have to move out, i have a dilemma.


Here is the text i found in the form:
"Wir teilen Ihnen mit, dass wir unsere Wohnung zusammen mit die Garage Parkplatz-Nr. auf [Zeitpunkt des vertraglichen Kündigungstermins] kündige."
What date shall i put at "auf [Zeitpunkt des vertraglichen Kündigungstermins]"?


I am really confused and i want to ask you: shall i put the date of today or the today + 3 full months(i.e. 31st of August)?

You put down the date you want to handover the house to the landlord. (and make sure that date is legally a correct date)

You send the notice now with the termination date as per your contract. So in May and 3 months cancellation notice, you cancel the rental agreement per 31.08.2020. Just check your contract?

one more question: Basically we can leave the apartment earlier, like in 2 months. Shall i put a note about this in the letter i will send to the Company?
I know that i will have to pay 3 months anyways, but maybe i found someone to get in earlier(hard to believe, i know, i am dreaming :-) ).



BTW: Kundigungsfrist==3Monat(e)

You can write:


Ich kündige hiermit den Mietvertrag und den Garagenstellplatz per 31.08.2020, möchte aber darauf hinweisen, dass wir per 31.07.2020 ausziehen wollen. Bitte teilen Sie uns einen Termin für die Übergabe mit.



(I cancel per August but want to move in July, please inform us on a date for the handover)

If you cancel and find somebody else than unless the landlord agrees otherwise the new person will take-over your cancelled contract.

Just tell them that you'll cancel per the agreed upon date, but that you are able to cancel the contract 1 month earlier if a candidate is found who likes to accept earlier. Depending on your location and the house finding a new renter might be a matter of just a few days, or several months.

Also mind that if you would find a new renter that a landlord is allowed time to proof the candidate, which could ruin the new person taking over during the 3rd month.
