Regies fees for withdrawing application

Me and the Mrs. got the news today that our application for an apartment has been successful (followed the always helpful tips here, managed to find an apartment in 20 days in Geneva).

So the main problem now is this: we applied for many apartments as this is the game. However some of the regies have fees (around 300 CHF) if you withdraw your application/refuse the house if they call you back.

At the moment I have a couple of applications for apartments I'm 99.9% sure I won't get (the ads were deleted by their websites, etc). Another couple are from Regies that didn't mention any withdrawal fee (small regies).

I have two applications open for two apartments that might be tricky:
1) one with a Regie that in their T&C said that the offer is binding for 10 days. The 10 days have expired so I'm positive there won't be charges if we withdraw
2) another with a Regie with a nasty reputation. I also think there is a good chance we might get the apartment as the current tenant really liked us and probably recommend us the Regie. I applied on the 19th so still quite recently

So what should I do? Withdraw also from this regie and get the charge (btw those are legal? Asloca can challenge them for you if you are a member?) or should I wait a few days and then withdraw hoping I don't get any charge but risking to have them calling me back offering the apartment?

Suggestions?

Turns out they cannot charge you. What really happened in my case was, the lady from the agency contacted me, said they are ready to send me the contract, and "let them know soon if I want the flat or not so that they do not spend wasted time on preparing the contract and then have to charge me for that".

I said I didn't want the contract, and it was fine.

similar experience. They were annoyed when we declined the offer, but by then we had found something better....


As long as you have not agreed to the offer...it's just an offer... the 'timewasting' is when they offer, you agree, they prepare the contract (and stop looking/advertising) then you turn it down...

It's an expression of interest, It's the agency that makes the offer, if you accept then the fee is payable if you don't sign.
