Hand out the key by friend, need for power of attorney

Hi there,
I about to leave Switzerland, however, will have my apartment for another month. I asked a friend of mine to hand out the key during the final inspection on behalf of me. Agency days that I could do so by giving a power of attorney to my friend. I asked them for more details but didn't receive anything back. DO you know a cheap and fast way to get such a thing, or alternatively, do you think that a simple note with my signature would suffice for this purpose?

You need to give your friend a
Procuration individuelle

and tailor it to your specific needs.

Write it out and sign it and notarize it at your local commune, cost is CHF 20 or so.

(important not to sign ahead of time)

My wife often does it for me so that I can deal with certain legal matters of hers. They can be time limited, limited to certain acts, etc.

You don't need to have a simple power of attorney notarized by anybody. Your signature is sufficient. Just state clearly what you expect your friend to do for you and when and your friend's name and address. Oh, and by the way, make sure your friend takes some valid ID with him/her.


You only need to notarize power of attorney if you want to give somebody else access to your accounts or when buying or selling property etc, in which case you'd need a different template.
I don't know if you're fluent in French. If not, you can download the Italian version so you fully understand what you're signing.

it's called Procura Speciale in Italian.


I'd send one copy to your landlord/agent ahead of time, with a covering letter, and I'd give your friend another copy (both copies dated and signed individually, so that they're both originals). That should dot the i's and cross the t's.

No, but it is recommended if it's to lend someone your car, do business dealings, etc. (either I am lending someone one of our cars, or I am dealing with lawyers and notaries on my wife's behalf).

And apostilla if it involves foreign countries (our usual case).

But who is going to pay for any cost, re cleaning not being up to scratch, or any repairs. Personally, I would not accept such power of attorney for a flat hand-out - too much risk and cost involved if things go wrong. Why don't you hand the flat over now and just pay for the extra month and forget it.

There is no risk, the OP is responsible for any costs, not the person with the POA.
