Renting not cheap apartment that isnít freshly painted

I’m moving to another apartment soon, the contract is signed but the real state agency refused to confirm on the phone whether they will hand in the apartment freshly painted or not.

Is this legally a tenant’s right to get the apartment painted upon start of the tenancy? The previous tenant was living there for 9 years or so, when I saw the apartment it had couple of wall marks here and there ....

After reading this, from what I understood and to my surprise, the owner or agency is not legally bound to give you a freshly painted apartment, is that so?

No legal requirement to be freshly painted.

If the paint is over 8 years old, you can't be charged for damaging the paint work, the agency will usually paint in such circumstances.

It can to your advantage not to have it freshly painted. Just take photos when you move in. If they freshly paint and you leave after a couple of years the expectation is that you will hand it back in pristine condition. If any of the marks bother you, it is easy to paint over them yourself.
The agent is dependent on the owner giving the OK for a re-paint. With pension-funds that is normally no problem but private owners can be idiosyncratic.

Why is every occurrence of the word "freshly" on this thread linking to a commercial site selling food products? Is this a subtle new way of placing adverts on the forum, or is it just something in my settings?

There's a setting in your profile called "Disable ad word links". Untick the box.

as pointed out, the bar is extremely low for you regarding the paint on the walls and should be noted in the handover protocol.

If it bugs you, ask them if you can paint yourself with no obligation to return to original colour at the end of the rental contract.

What? I see nothing in my profile about disabling ad word links. I do have AdBlockPlus installed though, but I wouldn't have thought it would hide that button in my profile.

If you are taking over the lease from another tenant (they left at a non-contractual time), I know you have to accept the apartment the way it is. The rules are different, but I don't know if that's the case for you.
