Tenancy agreement - what happens if i get fired? Hi, I recently signed a tenancy agreement, but I might lose my job. As i don’t have a year in Lausanne, I’m not going to receive wellfare. Is there a law that could help me to resolve the lease problem? |

Re: Tenancy agreement - what happens if i get fired? Legally you're obligated to pay the lease until the end of the term unless you find someone else to take over the lease. Even death doesn't get you/your heirs out of paying the rent. :eek: If you lose your job, the best thing to do is give notice as required and work hard to find a replacement tenant. In German that's called a nachmieter. I don't know the term in French or Italian. A replacement tenant is someone who agrees to take over the existing lease including length of lease and costs. |

Re: Tenancy agreement - what happens if i get fired? Hopefully you will not lose your job- fingers crossed. But no, no reduced rent possible in 99.9999 of cases, unless you have a very good personal relationship with owner. You need to find another tenant who can afford the rent. |

However I've heard that when you definitely departure from Switzerland you can cancel everything on the spot disobeying the contractual terms, just showing the confirmation from the commune. *I don't know if that's true, just heard it a few times Quote:

Re: Tenancy agreement - what happens if i get fired? Rav - to sublet your appartment should be a breeze, I understand your unfortunate situation, covid creates many lay-offs and bankrupcies. You should better inform your landlord if in fact that situation is coming. Maybe they have family/friends that need to take over. But it sounds like then you wouldn't have where to live at all? Would you leave immediately? Good luck with all. |
Re: Tenancy agreement - what happens if i get fired? From what I understand of the rules, you only need to provide one solvent tenant, i.e. someone who can afford the apartment. You don't have to do a search far and wide for 50 people and find the next great renter. If the landlord rejects that person for any reason other than not being able to pay, I think you're off the hook. It's unlikely you'll have trouble finding someone in Lausanne to take over your lease terms. Just make sure that the candidates you put forward can cover it financially and have a valid permit. Someone else probably has links to the relevant statutes that can back up the "only one solvent candidate" language. @Gravity - No, deregistering and departing Switzerland doesn't relieve you of any and all financial obligatons including rent. You can use deregistration to get out of phone contracts and gym memberships often with cancellation penalties, but it doesn't get you out of a lease.;) |
