Reprise de Bail

Dear forumers,

Hope you can help me with an advice on this issue.
I am currently subrenting an apartment (officially through the regie). I like it a lot and want to retake the lease from the current owner. However, the contract the regie sent me concerns me: there will be no work done and no etait de lieu (inspection) carried, while they want my signature that I will return the apartment in the same condition it was when the current owner signed the lease (which was 6 years ago!). Obviously there has been some minor wear/damage to the apartment e.g. some floor cracks, wall marks in those 6 years. The owner is happy to pay for whatever needs to be done, but they completely refuse to inspect/assess the apartment, saying its between the two of us how we will do this. I really like this apartment and want to continue living here, but this is a very weird situation and I dont want to be forced to pay for some floor cracks that happened before my arrival in the future.


Has anybody been in this situation? What can I do?

Two way street - if you do not sign anything about condition of the apartment - how you may be taken responsible for demages due ?

unit you pay directly into the account of the owner - than he'll unlikely see you money again . Use of brokerage/insurance company rather than real deposit would be an option ?

Same happened to me.

Though since they kept the rent price also what it was few years ago, I just accepted it. Location was just too perfect. Seems like it's a common deal these days.

the original tenant would have signed something to the condition of the apartment 6 years ago and that will be the baseline. ask to see that original document then you will see what existing damage there is.
