Building machine noises are super loud in our apartment

Hello,

My partner and I just moved into a new building with the apartment on the first floor. The apartment is great and has everything we need, so we were thrilled when we moved in. However, we can hear machine noises SUPER LOUDLY, especially in our bedroom. It sounds like water pumping (we can even feel vibrations on the floor); maybe heating or the water system? We’re not entirely sure, but we’re wondering if there’s any regulation for buildings regarding this? Can we do anything at all? The property owners are a large agency in Zurich…

Call and talk to the property owners. Is this a temporary thing or an ongoing issue with the flat? Perhaps the previous owners moved out simply because of the noise. If a flat has a high turnover rate, there's usually something wrong with it.

All the time or intermittently?

If you are a tenant in Switzerland, make sure you join Mietverband/Asloca- very cheap and they will advice and legal expertise in all tenants' issues.

As olygirl says ... But then what would the tenants' legal redress be in such a case. If the Agency did not declare the issue with noise, and it is a permanent and recurrent issue- surely they should be able to break the contract early without loss? Again- Mietverband will be able to help here- but talk to neighbours and caretaker first.

Did you not notice the noise when you came to visit the apartment? How long did it take you to secure this place? If you got it quickly and easily, in Zurich- then perhaps this is why.

The noise is definitely from the heating boilers. We hear it from 9.30 in the morning to the evening… Unfortunately, we didn’t hear it before because we visited the apartment before the heating season. As for getting the apartment: we had applied for the one above us, which someone else got. Then this one became available - all we knew was that the previous tenant lived here for one year with his girlfriend, but then they broke up and both left. No one mentioned this noise, but it’s horribly annoying!!! It doesn’t stop - it is a continuous noise for hours and hours. Does anyone know if there are rules regarding hearing machine noises constantly?

As already mentioned in this thread, you would do well to join the tenants' association (Mieterverband).

As it happens a quick search of their website brough up this article (German so get your Google Translate out) which describes your situation exactly.

The first step will be to bring the issue to the attention of the landlords / letting agency first by phone call then backed up with a registered letter - preferably in German.

Of course it may be that the only option is to find somewhere else to live if the issue of noise cannot be rectified satisfactorily. In the meantime, maybe invest in some decent earplugs.

Your first step is to inform the rental agency of this defect. They legally have an obligation to fix the defect. If it is not fixed, then you have the right to request a reduction in rent:

But, do not take any such measures before the situation has been properly discussed!

The outcome of such a dispute will depend on the „expectations“ of the rental. For example, I live in a wonderful house and apartment built in 1905 at the rental price of the time that I took out the agreement in 2005, and accept that my bed vibrates when the apartment below closes their wardrobe sliding doors. But they are ‚otherwise‘ great neighbours.

If I was to move to a new-build however, I would expect that such problems do not occur.
