RDKNL has no particular reputation at present
Landlord refuses to return deposit

I have tried everything, we transferred the deposit to the landlords account who did open the special deposit bank account but never transferred the funds we paid there.

We moved out over a year ago and they refuse to return the deposit, I don't know what to do and need advise here.

It is CHF 10,500.00 which we want back, any advise is welcome.

Or a lawyer?

Do you have legal insurance?

Just to clarify - you transferred the deposit directly to the landlords personal account, and not directly to the legally required deposit account. The landlord then kept the deposit of CHF 10’500.- for himself, and did not transfer it to the legally required account, which is in your name, but requires both signatures to make a removal of funds?

If this is the case, then your landlord is acting illegally. You should have been provided a payment slip so that you transferred the full amount directly to the deposit account, not to the landlord.

You can denounce him and / or you can go yourself to the Bedienungsampt (sorry for spelling - I'm sure someone will put the correct spelling).

First send him a registered letter giving your bank details and 7 days to comply, failing which you will take further action.

If you have legal insurance then I'd suggest to contact them first. Probably one letter from them would be enough to get your deposit back. If not, open a Betreibung against him at the Betreibungsamt.

UPDATE:

I have now received a my returned recorded letter to pay my deposit back. The letter was not picked up by my landlord and is returned. Not sure anymore what to do, any help is appreciated.

How annoying for you! Is your landlord a company, or an individual person? Research, either way, for alternative addresses.

First, if it's an individual, make sure they're still alive. People do die and it could be they've passed on and whoever is dealing with the estate may not know anything about this.

If they are alive or if it's a company then do as suggested and open a Betreibung at the Betreibungsamt.
