Construction outside our apartment

We moved into our fantastic apartment just under one year ago. Abour three days after we moved in, massive construction began right outside (building a train station/tunnel). The construction will continue for the next four years and often work goes on through the night (mostly drilling). Although we get regular updates with regard to the progress, we were never informed about this before we moved in.

Do you think we are entitled to any rent reduction or compensation? We are paying a pretty high rent and we cannot actually open our windows any more for the noise.

If you don't already have it unknowingly or exaggerate the duration or intensity of the noise, you most likely have the right for a rent reduction. We have discussed a similar case where the landlord was responsible for the construction work, but his involvement is irrelevant.

You can take a look at the Bulletin linked in this thread. Chapter 10 lists some court cases for rent reductions because of construction work in the neighborhood.

Additionally, this PDF in German explains how to proceed to get a reduction. In brief you start with contacting the landlord and demanding a reduction in writing, based on the bulletin's numbers. To reduce the rent on your own will likely backfire, on the other hand.

Does anyone know if you can retrospectively make a claim for rent reduction for building work that has gone on for 3 years?

Basically, I wasnt that bothered but our landlord is now being an idiot and giving a bad reference to future landlord, basically stopping us from finding somewhere to live.

Probably not as you should have complained at the time.
However, speak to the Tenants Association (it's called ASLOCA down here, MIET-something? in the german part), especially if your landlord is now causing you problems. They'll certainly be able to help with that.

Not sure that will work as any 'loss of use' IE balcony for noise/dust would have to have been raised at the time. It would also be a factor if the work was started before you moved in as it could reasonably be argued that you knew about it before hand but went ahead anyway. I would contact the MV and see what they say, regarding that and any ref' issues.... good luck:
