Getting kicked out of an apartment - rights?

i just got word that our apartment agency is serving everyone in the building with notice to leave our apartments in 3 MONTHS. is this legal? 3 months is absurdly short, especially given the market situation here in switzerland.

where can i read up on renters' rights? any EFers got experience in this area?

man, that blows.

i don't know exactly why yet, wife just called me at work with the news, but i think they will either be doing major renovations or tearing it down completely and rebuilding it.

do we at least get the right of first refusal for the new apartments?

See the above mietverband link, but these times can usually be stretched up to a few years. Requires legal work, though.

Maybe one of these two links might help.
My French is not so hot, but maybe this is the Mieterverband for Vaud. Mind you, it might be the 'Vermieterverband' for all I know!
This is similar Info to one of the links above, but in English.

The law various so much from place to place - as always in Switzerland - so no matter what Info we give, you must check it with the local authorities as 'facts' given may be valid in Zürich but not in Vaud.

I would forget that and look for a new flat ASAP.

I know it seems unfair, sad, etc... But It's probably a race against time for you, already started...


ps: Otherwise you can get MEMBERSHIP for ASLOCA.ch, the association which helps TENANTS in Swisstzerland-

You have to pay for membership though, i think something like 40chf a year (not sure):

so now there's an emergency neighbor meeting in my apartment at 7pm. just what i wanted after work today.

we're going to hash out our situation and do something collectively as a group with a lawyer. fortunately, we have a couple of corporate lawyers in the building, one already with a lawsuit against the agency. so we have someone to blaze the legal trail. sounds like the 3 months is a formality, we have a time period to oppose, then it will get put on hold, possibly for quite a while. fingers crossed!

Not that anyone likes to move - but do keep in mind that April 1 is a very popular time to move around here and there could be many things open for that time (which give or take a few weeks should come close to the time that they give you).
Perhaps you should just argue that you can keep most of your deposit (or all of it if they just plan to tear down the place) and look for a new apartment with another agency? I had a previous apartment with Regimo and had no problems. It sounds like a lot of work now but in the end it appears you will have to move. Maybe worth saving the headache and just fight to keep your deposit and not have to "clean"...

so quite a big story since my original post. the gist of it is that livit, working for swiss life, is trying to take down our building and replace it with high end apartments, replacing our garden area with another building. this will reduce the green space in Pully, and also disrupt the views from neighboring buildings.

as already mentioned, is that the neighbors have hired a lawyer to fight the eviction. one neighbor has taken it as his personal vendetta against livit and swiss life (owner of livit) and has created this website devoted to the conflict (in french):

a petition was created and over 2000 signatures received from the community in order to save the buidling.

More greenspace and less high rise apartments definitely make for a better living environment.

Can the Mietverband help, if the OP is not already a member? I thought I read somewhere one must be a member for 3 months before legal benefits are offered.
