Notice of termination:Example in German needed

All, I have to send my Notice of Termination but my German is not that good and prefer to send it both in german and English.. Anyone can share an example in German? Or even in English? thanks a lot!

Which basically means;

You need post it registered. To do this you write EINSCHREIBEN written in block letters on the top of the envelope as otherwise your landlord could very well argue they have never received your notice letter.

Which basically means:

Writing "Einschreiben" on the envelope is not enough to actually get your letter sent registered mail. To send it as a registered letter, you need to take it to the post office and request this (and pay a bit extra). Keep the receipt they give you, this is proof, should you need it, that it was sent.

But do you need to have this sentence that you ask them to confirm that they have the letter when you are sending the notice via registered mail?

It's always better to be on the safe side. That way there is absolutely no question left open, they have received and also read and understood what you have communicated.

Important Information

You should post this as soon as possible, at least 8 days before the due date!!

Explanation:

Legal date of delivery for registered letters??

Copy of my original posting:
The notice is only valid if it no later than the last day prior to the notice arrives at the receiver. Since your landlord was not at home, he was the mailman has put a collection notice in the mail box. In this case, notice shall be served on the day on which the recipient to pick up the letter by the PTT was possible for the first time, by the last day of the seven-day collection period. Even if the registered picked up at all and therefore will be returned to the sender, is the termination on the last day of the collection period served. It is therefore recommended to the seven-day collection period from the beginning with einzuberechnen and submit the letter of dismissal so early that the notice is preserved even in the non-collection. The first day of the collection period is likely in your case the 30th have been in October, the last day of collection, therefore the 5th November. That day is already in the notice. Your letter of termination is therefore out of time the landlord arrived and is automatically on the next call date.

Sorry, I am just confused - you are giving notice now for the end of the current month? What does your rental contract say? I'm asking because many rental contracts require you to give three months notice to the end of the month, i.e. you would be giving notice now for 31 January 2011.

I'm giving 3 mo notice now... the 3 mo start end of the month you give the notice or on the 1 of the folloiwng month... hence, the notice should be received before the end of Oct and the 3 months notice end Jan 31.

If I find a place earlier and a new tenant is found - then we negotiate. sorry for the confusion... I am confused with all myself

Hi, can anyone help me with my German. I need to cancel an employment.
"We hearby give (name of firm) notice that we wish to terminate your employment". This is a bit tricky because there is no contract. This is a firm of Treuhands that a group of us wish to dismiss. None of us ever signed a contract and now we wish to change to a new Treuhand. So I need a simple sentence that does not give the view that we believe there is a contract, but which succinctly states that we will terminate this arrangement at the end of the year.

So this is B2B, not any kind of personnel employment, right?

Is you company registered in the Handelsregister? If so, I think (ie I may well be wrong) the Revisionsgesellschaft mentioned there needs be changed as well. Ask your new Revisionsgesellschaft, they know the details already.

Do note though that even if neither of you signed any contract, there still may be an old one effective. If you folks bougth the company, you did so assuming all existing debt and obligations, including such a contract if there was one.

As for the letter itself, based on the above:
Sehr geehrte Damen und Herren

Hiermit informieren wir Sie, dass wir in Zukunft eine andere Gesellschaft mit Buchhaltung und Revision für xyz beauftragen werden.

What is the Treuhaender doing for you?

If you are a company and they are your registered auditor you have appointed them at your AGM or partners meeting. So it's not as simple as sending a letter. You'd have to appoint somebody else and inform the commercial register. But I cannot imagine that they agreed to become your registered auditor without issuing an engagement letter.

If you just use them for bookkeeping or whatever then yes, just send a letter, be prepared to be invoiced for any work they have done for you to date. Written form is not required for most contracts under Swiss law.

This is just the house owners giving notice to the accountant. No one seems to have signed a contract, although he has produced one (no signatures) that none of us have ever seen, saying we have to give 3 months notice. He's been in place for 5 years having been brought on board by one of the owners. There was implicit agreement that we would take him on (although one owner objected from the outset). He gave us a cost estimate that he has never kept to. Now we are going to someone cheaper.

You keep not providing the necessary info, including the extent of the work he kept doing for you.

Send the above example and see what happens. It probably won't be enough but the guy will inform you what's required; in all likelihood he'll require a protocol of the owner's meeting where they are shown to decided to change the accountant/Revisor.

The owner's meeting protocol will probably be necessary nonetheless, you're right with that. He may accept the termination regardless but OP shouldn't be surprised if he doesn't.

It's a house with just 6 owners and the accountant has held a once yearly meeting and keeps account of income and expenditure (income being the contribution made be the owners so that the bills can be paid). It's a simple enough job: making sure the cleaner and the insurance is paid.

The last AGM was March. The accounts are always to end of year, so it makes sense for him to finish at the end of the year. The owners have not held a meeting to decide to sack him but they are 100% in agreement.

Urs Max - I sent exactly the wording you gave me. A read receipt came back but no other answer. I'd say he's ignoring the email, although it was copied to all the owners.

Usually any decisions made outside the owners' meeting have to be unanimous. You need to send a letter with all the owners' signatures for it to be acceptable. Unless of course your reglement says otherwise.
