Question regarding Car accident insurance claim process

Dear All,

I have gone through this forum but could not find relevant topic. Kindly redirect me to the thread in case it already exists

I was driving on road with sharp curve and while I was driving on my lane another car from opposite direction was trying to overtake another car at this junction. Since the road was not wide enough and both on comming car and my car was speeding at 65 kmph the car hit my car on left side and completely damaged my left side part. In addition this driver after hitting my car suddenly applied break and another three car approaching hit him from rear. police was called and they completed all formalities and got my statement as well with all other drivers.

Just in case it helps I have learners licence and I was with one of my friend who has swiss driving licence for last 20 years.


Comming to the point, police told me that there will be another department who will decide whose fault was it and based on that we will get letters with all the contact details after which the specific insurance company will review the demage of the cars involved.

My question is Could anyone explain me if I could be in trouble and it could be my fault. my friend who was helping me to learn driving told me that there is no question of our fault here as the oncomming vehicle was completely on wrong lane but so far I have not recieved police confirmation and not sure how the process works.

Could someone help me to understand the process further. My guarage suggest not to repair the car as it would cost lots of money and insurance may want to buy the car and pay me cash.

Questions :
- Since I never discussed with the driver who was driving in wrong lane I am not sure how police will decide whose fault it was.
- Will this have any impact on my driving licence or on practical driving test which I have to appear.
- Is there any chance that another driver may have recorded something which is not correct which could turn this as my fault.
- I thought police take the statement of both drivers upfront but this never happened.
- Is there any way to further provide further details in case it is considered as my fault due to the fact that I was driving on learners permit

Would appreciate your help on this in case someone here knows the process of have been into the similar situation in past.

Quite offen several Drives Will be found Guilty and given a fine, you may have to Appeal , be en there done that & won! Good luck

Decisions have to be made whom is to blame and by how much. From your story the other driver is 100% to blame, but the police cannot make a decision until they have all the facts. Were there road marks from your heavy braking, did you take a photograph?

I wouldn't worry too much, you have a witness who is not your relative, so he can substantiate your story and your driving actions.
