who pays?

obviously the short answer to this question would be to ask security here at my office but I thought I would first try the collective wisdom of the EF.

I parked my car in the company parking lot, which is also a public access parking ( UN - Nations for those that know GE ) and sometime between Thursday morning when I parked and Sunday night when I returned for the car the passenger side window was smashed and the glove box rifled thru -- fortunately there was nothing stolen ( there was nothing to steal ) but I now have the aggravation of having the car repaired and the CHf 500.-- deductible on my insurance.

As I was parked in the , in theory, secure parking is there any shared liability?

Check the fine print on your parking agreement. I'll be surprised if the liability is not completely yours. I hope I'm surprised though.

Re: who pays?

you're probably right, but I don't remember ever signing a "rules and regs" ( unlike here at Camp EF )

the only thing I have on hand is an agreement for payroll deduction for the parking fee's

Check your T&C's of employment. Sneaky companies put as much into those as they can because they think most people will only read the salary & benefits pages.

Re: who pays?

Usually no liability is taken for a car park especially if it is shared with the public.

What sort of insurance cover do you have? If you have some thing like our Glass Plus addition to your casco you might be able to make a claim with no excess or penalty.

I'll have to check my policy but the repair was written up yestd they noted a CHf 500.-- deductible

all rather moot at the moment... I got a call about 2 hrs ago that the repair is done and the car is ready to be picked up.

Re: who pays?

the question of who pays is still out there ( yes, I'm sure it will be me )

but.. I have to send major kudo's out to Zurich Insurance.
Mrs. G dropped the car off at their "help centre" monday mid-day and we were told it would probably take a couple of days to source the glass ( Daihatsu ).
We were given* a rental and were told they would contact us in a few days.

I got a call yesterday early evening to say the car was ready, and I've just picked it up... repaired obviously...vacuumed obviously... but also washed and waxed.

all in all friendly and excellent service

given* = after paying premiums without a single claim in 12 years.

Re: who pays?

Everyone is missing a key point here:

Nobody will pay without a police report.

a) REPORT IT TO THE POLICE that your car has been broken into.
They will advise you what to do.
b) report it to authorities where your car was parked.
c) REPORT TO YOUR INSURANCE. You will need the 'police number' for the claim to be processed.

Your insurance should pay, and they will probably try to subrogate the costs from where the car was parked.

Hang on:
  • you've dropped the car off to the insurance company
  • they gave you a hire car
  • fixed yours
  • you have a 500chf deductible
........ what exactly is the problem here?

Sounds like the insurance already is paying to me.
They would only send you a bill if the costs were less than 500chf

.......less than 500chf...... IN SWITZERLAND !!!!
(sounds like you will cough up 500, and that'll be the end of it to me)

ok... I guess I didnt' explain ...
got to the car sunday night 10pm ... phoned police, they said I could report in the morning at my local station

monday morning I went to three separate police stations... each was closed

in exasperation I went to Insurance "help centre".. they said since nothing was stolen I didn't need a police report and they have processed the claim and returned my car to me fixed, washed, waxed.

I have also reported to my organization security section and they have filed the incident report with the group that handles parking lot [lack of] security.

you're not really paying attention are you?

my original question in my original post above was is there any shared liability with the parking garage?

Then pay attention to my earlier post where I said this:

Your insurance should pay, and they will probably try to subrogate the costs from where the car was parked.
OK, so how this works is as follows:

You insure your car
The carpark will insure against theft/damage etc.

Where two policies cover the same accident, insurance companies enter what is called "Subrogation".
This means that they will decide between themselves who is most at fault and how to share the costs.

The good news for you is that usually one or the other will pay you first to keep you happy..... but you can't claim twice.

It is illegal to have multiple insurance polices on an item of interest, and
Illegal to insure an item that you have no 'interest' in.

(eg. you can't take a life insurance policy on someone and shoot him dead for the money.... bad example, but you get the point).

So for your case, your car insurance company was contacted first and they pay you.
They will likely contact the insurance company of the car park to try to recover some of their costs.

You pay your 500chf, get your car fixed, and walk away.

Re: who pays?

you park a car leaving it unattended for several nights in public place without leaving the glovebox open and are surprised it was broken into?

regardless of insurance, i think you should pay!

Or you could have loads of money but not like to show it

When our car got broken into, we went to file a report at the main police station in Geneva (its was 5am!)

Got the report, called the insurance the next day, got a claims number and took the car to the citroen garage. Then sent the police report to the insurance. Got a call a couple of days later to pick up the car. Cost? A nice big zero. Didnt get any bill, didnt get premiums increase.

I think it helps that im a bit paranoid and got the most comprehensive insurance ever

Re: who pays?

Actually you may not have to pay anything!

Our new policies have no excesses on glass coverage unless you actually opted for one, some of the older ones had a 200. Now there is generally no excess due on any of the casco covers, the deductible only comes into force with accident on the full casco or the mandatory 1000 enforced on the TPL ( 3rd liability ) for drivers under 25.

If you send me a copy of the policy or give me the number I'll let you know.

the only police station open at that hour was in the Paquis..
mrs. wasnt thrilled about going down there then, in a car that was already broken into.
