Scratched neighbors car, but...

Hello,

While the two cars were parked in the basement garage, I managed to scratch my neighbors car, by opening my car's back door a bit too wide.

The owner showed me another scratch, near the same one. On the spot, we decided that it was too high for me to have done it, and we filled and signed an "accident report" that says "1 scratch" on it. The next week I saw that the neighbor got both scratches fixed, and I received a bill of 900CHF. I talked to the garage and they said breaking the cost down per scratch was not possible. Which is understandable I guess (they do the whole door).

I will submit a claim to my personal liability insurance (I checked they cover this). But I have an excess of 300.

Should kindly approach the neighbor to contribute to this, or just suck it and move on?

I would estimate one scratch very close to the other one would be the same to fix as if there was only one scratch.

It depends on the relationship you wish to maintain with your neighbour.

I would look at like this. Your neighbour had repairs done to his car in addition to remedying the problem which you caused. If you tell that to your insurance company, in the way you have told us, they would probably pay only 50% and still charge you the excess of Fr. 300.-. Your neighbour would, therefore, lose CHF 450.-

The other way to look at is this. Your neighbour had a scratch on his car which you didn't cause and which he wanted repaired. The marginal cost of repairing, in addition, the scratch which you did cause is minimal, so you should pay nothing and he should pay the whole bill. He is effectively supporting the principle of this argument himself, except he is saying the person responsible for scratch number 2 should pay instead of the person responsible for scratch number 1.

If I was dealing with him, I would probably split 50/50 your uninsured loss with him and ask him to pay half your excess (CHF 150.-) .

If it's metallic paint you got to respay whole pannel anyway, so it's all a bit irrelevant.
